France packaging EPR for non-EU sellers (Citeo, REP emballages)
You appoint a representative in France by written mandate, then join one of three eco-organismes (Citeo, Adelphe or Léko), which registers you with ADEME and sends the IDU for household packaging. The representative duty has applied since 10 July 2026, to sellers in other EU countries too. Under 10,000 consumer sales units a year, Citeo and Adelphe bill a flat EUR 110 excluding VAT. Without an IDU, the fine is up to EUR 30,000, on top of up to EUR 7,500 per unit or tonne.
If you ship packaged goods to a buyer in France, you appoint a representative in France by written mandate and join one of three eco-organismes: Citeo, Adelphe or Léko. The eco-organisme registers you with ADEME and sends you the IDU for the household packaging scheme. The representative duty has applied since , and it reaches a seller in another EU country as much as one outside the EU. Under 10,000 consumer sales units a year, Citeo and Adelphe bill a flat EUR 110 excluding VAT.
The EU rule, and who counts as a producer, is in packaging EPR in the EU and PPWR. This page is only what France adds. The other French rules are on the France page.
Do this, in this order
- Count your packaging in consumer sales units (UVC). Citeo counts the product in its pack as 1 UVC and the shipping carton as another, so a parcel is 2 UVC (Citeo guide). Adelphe’s 2027 guide counts each shipping element on its own: a carton, a tape and a filler are 3 UVC (Adelphe guide).
- Appoint a representative in France by written mandate. It can be a person or a company established in France (L. 541-10-9-1). Who can act, and for what, is in authorised representative for EPR.
- Join an eco-organisme from the table below. With Léko, the mandate goes to Léko and the representative signs the membership contract (Léko).
- Receive the IDU. The eco-organisme registers you in SYDEREP and sends it (ADEME). The IDU is one per scheme: what to enter in each field, and where to show it, is on the IDU page.
- Declare each year and pay. Citeo’s window is January and February of the following year.
- Give the IDU to each marketplace, and put the Triman logo and the sorting instructions on the packaging (Triman page).
The representative duty has applied since 10 July 2026
Before that, French law did not require a representative. Article R. 541-174 of the Code, which let a producer designate one who took over its EPR duties, was annulled by the Conseil d’État on , because no law then provided for that transfer (decision no. 449213). Since the law no. 2026-602 of , a person not established in France that is subject to EPR appoints one (article L. 541-10-9-1, inserted by article 5, Sénat file). The law was published in the Journal officiel of 9 July 2026. Article 5 gives a later date only to another of its points, 1 September 2026, so this one runs from the day after publication (article 1 of the Civil Code). Léko, one of the three eco-organismes, gives the same date, 10 July 2026.
The representative takes over the EPR duties it accepts in the mandate. In a collective scheme it declares your quantities through the eco-organisme (ADEME). The article names no fee, no licence and no language for the mandate, and no official fee for a representative is set. You do not need one for products whose EPR duties a marketplace established in France already meets.
Léko lists these steps for a producer established abroad: find a representative, sign a written mandate, send it to the eco-organisme to update your membership, have the representative sign the membership contract, and Léko updates SYDEREP. Citeo runs a desk for representatives managing several clients (Citeo).
Three eco-organismes serve household packaging
All three are accredited from 1 January 2025 to 31 December 2029 (ADEME, Ministry). Their tariffs are their own documents, not law, and they change each year.
| Citeo | Adelphe | Léko | |
|---|---|---|---|
| Minimum or flat fee, excluding VAT | EUR 110 minimum | EUR 110 flat | EUR 95 minimum |
| Small volume | Under 10,000 UVC: the flat fee | Under 10,000 UVC: the flat fee | Simplified declaration under 20,000 UVC capped at EUR 150 |
| Simplified declaration | 10,000 to 500,000 UVC | 10,000 to 500,000 UVC | Under 500,000 UVC |
| Detailed declaration | Over 500,000 UVC | Over 500,000 UVC | Required over 500,000 UVC |
| Tariff document | Guide 2026, updated 22 June 2026 | Guide 2027 | Barème 2026, version of 14 November 2025 |
You may join an approved individual system of your own instead of an eco-organisme (Ministry). In a collective scheme the eco-organisme must cover every category of product you sell, and you may need more than one (ADEME).
What it costs
ADEME states no fee for the IDU itself. You pay the eco-organisme’s contribution, and the minimums are in the table. At Citeo, you get a provisional invoice of EUR 110 when you join. Contributions over EUR 5,000 a year are invoiced in quarterly instalments. Below that, there is one invoice a year, paid in December (Citeo).
Only a detailed declaration earns bonuses and penalties at Citeo. They move the contribution with the design of the packaging: less weight, recycled content, reuse, or features that disturb sorting (ADEME and Citeo guide). The general level of EPR fees is in EPR fees.
Deadlines
| What | When |
|---|---|
| Appoint a representative in France | Applied from 10 July 2026 |
| Registration before first making packaging available in France | The EU rule is in packaging EPR |
| Declaration of the year’s packaging, at Citeo | 1 January to 28 February of the next year. For 2026, January and February 2027. The space opens in November (Citeo and its guide) |
| First declaration, packaging | From 1 January of the year you join. No earlier years (Citeo) |
| First declaration, printed paper | On joining, any paper placed on the market over the three last years, whatever the volume (Citeo) |
| Packaging sold to professionals | Catering packaging: its own scheme since March 2024. All professional packaging: a separate scheme from 1 January 2027 (ADEME) |
At Adelphe, packaging placed on the market in 2027 is declared from January to the end of February 2028 (Adelphe guide). Léko takes the declaration each year on its MyLéko portal, and its tariff sets no date for it (Léko).
Who counts as the producer
Since 1 January 2026 the Code does not define the producer on its own. It points to the EU regulation: a producer is any person as defined in point 15 of article 3 of Regulation (EU) 2025/40 (R. 543-43, decree no. 2025-1081). That is the producer test in packaging EPR. The Code calls packaging of products used by households, or likely to be, household packaging. Any other packaging is professional.
Citeo adds three cases for sellers abroad, which are its own reading, not law (Citeo):
- If you are based abroad and sell second-hand goods in their original packaging to French consumers, you are the first importer of that packaging and you declare it.
- Reused shipping cartons are declared, unless you can trace that they were declared when first placed on the French market.
- Goods sold fully loose, with no packaging at all, are not declared. Labels, ties, string and cling film count as packaging.
Marketplaces
For EPR products in general, a marketplace has producer status for the quantities it places on the market for third parties, unless it holds proof that you hold an IDU (ADEME). Whether Article 45 of the EU packaging regulation changed this rule for packaging is not stated by ADEME or the Ministry. The Ministry’s draft FAQ of 1 August 2022, which the Ministry still marks “en mode projet”, asks you for the IDUs of the product categories you sell, packaging included. It also lets a marketplace act as your EPR intermediary by contract (Ministry draft FAQ). The EU side is in packaging EPR.
The same scheme covers printed paper
The scheme merged household packaging and graphic papers on 1 January 2024. It covers printed paper, other than books, issued for end users in France, free of charge or not (ADEME). Citeo lists user manuals and leaflets among them, and charges nothing for under five tonnes of paper (Citeo). The same membership covers both, and the EUR 110 minimum covers both declarations.
If you do nothing
The minister notifies you of the facts and the penalty, you have one month to answer, and the minister then decides (L. 541-9-5).
| Breach | Up to |
|---|---|
| Not registered in SYDEREP, register not filled in or wrong data, or IDU not shown where it must appear | EUR 30,000, on top of the per-unit fine below |
| Any other EPR breach, except the measures of L. 541-9-1 to L. 541-9-3 (fined under L. 541-9-4) | EUR 7,500 for a company or EUR 1,500 for an individual, per unit or tonne of product concerned |
| Until you comply | A daily penalty of up to EUR 20,000 |
All of this is article L. 541-9-5 (Code de l’environnement, copy in Ineris AIDA). A producer that joins no eco-organisme and runs no individual system gets no IDU, so the first row applies to it. The article covers a breach of any rule in its section of the Code, except the Triman and sorting-information duties, which are fined under L. 541-9-4, and the duties of eco-organismes, which are fined under L. 541-9-6. The representative article, L. 541-10-9-1, sits in the same section as L. 541-9-5, so the fines of L. 541-9-5 reach a failure to appoint a representative. No text sets a separate fine for it. The per-unit amount takes into account the gravity of the breach and what the producer gained from it. The sums are also on Service-Public, and the fine for missing Triman and sorting instructions is on the Triman page.
Packaging for business buyers is a separate scheme, in full from 1 January 2027
Catering packaging has had its own professional scheme since March 2024. From 1 January 2027 all professional packaging has one, and each producer concerned must have joined an eco-organisation. Three were accredited on 5 June 2026: Twiice, Léko Pro and Citeo Pro. Household packaging stays in the scheme on this page (ADEME).
What does not apply
- There is no registration of your own in SYDEREP when you join a collective scheme. The eco-organisme does it (ADEME).
- There is no single French EPR number. The packaging IDU does not cover electrical equipment, batteries, textiles or the other streams (IDU page).
- No quantity is too small to join. A low volume means a flat fee, not an exemption.
- A SIRET is not required of a business not established in France. What to enter instead is on the IDU page.
The facts for France, with their sources
| Fact | Value | Source | Checked |
|---|---|---|---|
| Local representative | Yes, in every EPR stream, packaging included, and for sellers in other EU countries as much as for those outside the EU. A person not established in France that is subject to EPR appoints, by written mandate, a person or company established in France as representative. The representative takes over the EPR duties it accepts in the mandate. The text sets no other condition on who the representative is and names no language for the mandate. The duty counts as met for products whose EPR duties an operator established in France, named in L. 541-10-9, already fulfils. | Sénat, text no. 150 (2025-2026), adopted definitively on 29 June 2026: Code de l'environnement art. L. 541-10-9-1, inserted by art. 5, I, 2° | |
| Filing deadline and frequency | The duty to appoint a representative has applied since 10 July 2026. Article 5, II of the law dates only point 3°, c of its part I (1 September 2026), so the new article L. 541-10-9-1 (art. 5, I, 2°) has no start date of its own, and it refers to no implementing decree. The law, no. 2026-602 of 8 July 2026, was published in the Journal officiel no. 159 of 9 July 2026, and a law with no date applies from the day after its publication (Civil Code, art. 1). | Sénat, text no. 150 (2025-2026), art. 5, II: the only start date it sets is 1 September 2026, for point 3°, c of I. Publication in the Journal officiel no. 159 of 9 July 2026: Sénat legislative file; Civil Code art. 1: DILA (both in the sources list) | |
| Filing deadline and frequency | Packaging placed on the market runs from 1 January to 31 December. At Citeo you declare it from 1 January to 28 February of the following year, so packaging placed on the market in 2026 is declared in January and February 2027. You start declaring packaging from 1 January of the year your membership starts, with no back declaration of earlier years. For graphic papers it is different: on joining you declare any paper placed on the market over the three last years, whatever the volume. | Citeo, My membership (FAQ of the eco-organisme, not law) | |
| Filing deadline and frequency | Adelphe: packaging placed on the market in 2027 is declared from January to the end of February 2028. Léko takes its annual declaration, detailed or simplified, on its MyLéko portal, and its tariff sets no date for it. | Adelphe, Guide emballages ménagers 2027 (tariff of the eco-organisme, not law); Léko, Barème 2026 (tariff of the eco-organisme, not law) | |
| Filing deadline and frequency | Catering packaging has had its own professional scheme since March 2024. All professional packaging is covered by an EPR scheme from 1 January 2027, and each producer concerned must have joined an eco-organisation. Three organisations were accredited on 5 June 2026: Twiice, Léko Pro and Citeo Pro. Household packaging stays in the scheme on this page. | ADEME, Filières REP: professional packaging scheme (EPRO) | |
| Registration authority | For household packaging you join an accredited eco-organisme, and it registers you with ADEME and sends you the IDU. ADEME issues one IDU per scheme. In a collective scheme you cannot register as an individual. The alternative is an approved individual system of your own. | ADEME, Filières REP: unique identification numbers (UIN) in EPR schemes | |
| Register | The scheme is household packaging and graphic papers, EMPAP in French, one scheme since 1 January 2024. Three eco-organismes are accredited from 1 January 2025 to 31 December 2029: Adelphe, Citeo and Léko. OCAPEM is the coordination body, accredited until 31 December 2029. | ADEME, Filières REP: household packaging and graphic papers scheme (EMPAP) | |
| Registration fee | Citeo: a minimum billing of EUR 110 excluding VAT covers the membership and both declarations, household packaging and graphic papers. A member with fewer than 10,000 packaging units and under 5 tonnes of printed paper pays only that. | Citeo, Guide du tarif emballages ménagers 2026, updated 22 June 2026 (tariff of the eco-organisme, not law) | |
| Registration fee | Adelphe: a flat EUR 110 excluding VAT for fewer than 10,000 consumer sales units a year, with no figures to enter. The 2027 flat rate is the same as 2026. | Adelphe, Guide emballages ménagers 2027 (tariff of the eco-organisme, not law) | |
| Registration fee | Léko: a minimum annual billing of EUR 95 excluding VAT. A simplified declaration under 20,000 consumer sales units is capped at EUR 150 excluding VAT. | Léko, Barème 2026 emballages ménagers et papiers, version of 14 November 2025 (tariff of the eco-organisme, not law) | |
| How the fee is set | Citeo bills by the number of consumer sales units (UVC) placed on the market in the year. Under 10,000: a flat fee. From 10,000 to 500,000: a simplified declaration by product family, at a tariff per unit, with no technical data to give. Above 500,000: a declaration by UVC, which counts each packaging unit and material. Only the declaration by UVC gives access to bonuses and penalties. A shipping carton counts as one UVC of its own, so a product in its pack, shipped in a carton, is 2 UVC. | Citeo, Guide du tarif emballages ménagers 2026, updated 22 June 2026 (tariff of the eco-organisme, not law) | |
| How the fee is set | Adelphe uses the same three thresholds (under 10,000, 10,000 to 500,000, over 500,000 UVC). In its 2027 guide each element of a shipping or service package is a UVC of its own: a carton, a tape and a filler is 3 UVC. Adelphe marks this count as subject to validation by the coordination body. | Adelphe, Guide emballages ménagers 2027 (tariff of the eco-organisme, not law) | |
| Small-volume threshold | There is no volume below which a seller is outside the scheme: Citeo says the EPR scheme applies regardless of the volume of packaging or paper, from the first packaging placed on the French market. | Citeo, Why join Citeo (page of the eco-organisme, not law) | |
| Penalty | Article L. 541-9-5 of the Code de l'environnement. Any EPR breach other than those fined under L. 541-9-4 and L. 541-9-6: a fine of up to EUR 1,500 (individual) or EUR 7,500 (company) per unit or tonne of product, which takes into account the gravity of the breach and what the producer gained from it, and a daily penalty of up to EUR 20,000. On top of that fine, up to EUR 30,000 where a producer subject to EPR is not registered in the register kept by ADEME (SYDEREP), has not filled it in, gave wrong data, or did not show its IDU among its mandatory mentions. Sanctions are published. | Code de l'environnement, art. L. 541-9-5 (copy in Ineris AIDA, Livre V, partie législative) | |
| Penalty | The per-unit maximum is EUR 1,500 for an individual and EUR 7,500 for a company. | Service-Public Entreprendre: Filières à responsabilité élargie du producteur (REP), checked 4 August 2025 | |
| Enforcement body | The minister in charge of the environment notifies the producer of the facts and the penalty it faces, hears its written or oral observations within one month, and then decides by a reasoned decision. The sanctions are made public (L. 541-9-5, L. 541-9-8). | Code de l'environnement, arts. L. 541-9-5 and L. 541-9-8 (copy in Ineris AIDA, Livre V, partie législative) | |
| National rule | Since 1 January 2026 the Code defines the packaging producer by the EU regulation itself: a producer is any person as defined in point 15 of article 3 of Regulation (EU) 2025/40. Household packaging is packaging of products consumed or used by households or likely to be. Professional packaging is any other. The environment minister may set by order, by capacity, distribution channel or type of packaging or product, which packaging counts as which (R. 543-43, as rewritten by decree no. 2025-1081 of 17 November 2025). | Decree no. 2025-1081 of 17 November 2025, art. 2, rewriting R. 543-43 (Journal officiel no. 270 of 18 November 2025; copy in Ineris AIDA) | |
| National rule | Before the 2026 law, French law set no duty to appoint a representative. Article R. 541-174, which let any producer, established in France, in another EU state or in a third country, designate one in France who took over its EPR duties, was annulled by the Conseil d'État on 10 November 2023, because no law then provided for that transfer of duties. ADEME's IDU page still says "if you wish" and does not mention article L. 541-10-9-1. | Conseil d'État, decision no. 449213 of 10 November 2023, EcoDDS (annuls decree no. 2020-1455 in so far as it introduces R. 541-174) | |
| National rule | For EPR products in general, a marketplace has producer status for the quantities it places on the market for third parties, unless it holds proof that those sellers hold an IDU for the scheme concerned. The Ministry's draft FAQ of 1 August 2022 (the Ministry marks it "en mode projet") asks the third-party seller for the IDUs of the product categories sold, packaging included. Whether Article 45 of the EU packaging regulation changed this rule for packaging is not stated by ADEME or the Ministry. | ADEME, Filières REP: unique identification numbers (UIN) in EPR schemes | |
| Marketplace can file for you | Yes, by contract. A marketplace can offer a third-party seller an EPR intermediary service: it takes over the seller's EPR obligations and declares to the eco-organismes for each seller. The marketplace sets the terms, for example in its general terms of use. | Ministry for the Ecological Transition, draft FAQ on the application of the EPR reform to marketplaces, art. L. 541-10-9 (version of 1 August 2022; the Ministry page marks it "en mode projet") |
