AGEC law and France's other EPR streams for non-EU sellers (the filières REP)
The AGEC law of 10 February 2020 added streams to France's EPR list, which now has 21 in article L. 541-10-1. Toys, sports and leisure goods, DIY and garden goods, building products, household chemicals, lubricants and wipes are among those with no page of their own on this site. In each stream you join the accredited eco-organisme, which registers you with ADEME and sends one IDU for that stream. A seller not established in France also names a representative in France by written mandate, in every stream. Without an IDU the fine is up to EUR 30,000, on top of up to EUR 7,500 per unit or tonne.
France lists 21 EPR streams in article L. 541-10-1 of the Code de l’environnement, and the AGEC law of 10 February 2020 added many of them. If you sell toys, sports and leisure goods, DIY and garden goods, building products, household chemicals, oils or wipes to buyers in France, from any country, you are a producer in each stream your goods fall under. In each one you join the accredited eco-organisme, which registers you with ADEME and sends one IDU for that stream. You also name a representative in France by written mandate, in every stream, since .
The EU rule, and who counts as a producer, is in the EPR guide. This page is what France adds for the streams that have no page of their own. The other French rules are on the France page.
France has 21 EPR streams, and six have a page of their own
Article L. 541-10-1 lists the streams (Code de l’environnement, copy in Ineris AIDA). Item 3° is repealed, which leaves 21 in force. ADEME’s list shows 19 approved schemes. The two without a scheme page are chewing gum (20°, from 1 January 2024) and fishing gear containing plastic (22°, from 1 January 2025). Service-Public counts 21.
| Stream | Page |
|---|---|
| Household packaging and graphic papers (1°), professional packaging (2°) | Packaging |
| Electrical and electronic equipment (5°) | WEEE |
| Batteries (6°) | Batteries |
| Furnishing elements (10°) | Furniture |
| New clothing, footwear and household linen (11°) | Textiles |
Everything else is below. A single product can sit in several streams, and each one has its own IDU. The IDU page shows ADEME’s example of a smartphone that falls under three.
Do this, in this order
- Match your products to the streams in the table under “Each stream has its own eco-organisme”. Packaged products also fall under the packaging scheme, and products with a battery or electronics under the batteries and WEEE schemes.
- Name your representative in France, by written mandate (L. 541-10-9-1). The next section has the law.
- Join the eco-organisme of each stream. It registers you with ADEME and sends you the IDU. What to type in each form field, with no SIRET, is on the IDU page.
- Code and declare what you sell, and pay the eco-fee. Toys are declared every quarter at Ecomaison.
- Show the IDU in your general conditions of sale and on your website, and give it to each marketplace.
- Put the sorting sign and instructions on the product. It is the Triman logo, on the Triman page.
- Check the other AGEC duties (section below), including take-back above EUR 100,000 of delivered sales in toys, sports and DIY.
A representative in France is required in every stream
Article L. 541-10-9-1 says that a person not established in France that is subject to EPR under article L. 541-10 or L. 541-10-9 appoints, by written mandate, a person established in France as representative. The representative takes over every EPR duty whose mandate it accepts. The text is in article 5 of loi no. 2026-602 of 8 July 2026 (copy in Ineris AIDA). It names no EU or non-EU distinction and no stream, so it reaches a seller in another EU country too, in every stream. The duty counts as met for products whose EPR duties a marketplace established in France, named in L. 541-10-9, already fulfils.
The law was published in the Journal officiel no. 159 of 9 July 2026 (Sénat). The new article sets no later start date and cites no decree. A law with no date applies from the day after its publication (article 1 of the Civil Code), so from . The mandate in full, and the EU side of the role, are on the packaging page and in authorised representative for EPR. The representative sets its own price.
Each stream has its own eco-organisme and its own IDU
You meet the duty by joining an accredited eco-organisme, or by running your own approved individual system. Service-Public notes that the individual route is complex and that joining an eco-organisme is generally simpler. The streams most likely to reach an online seller:
| Stream | What it covers | Eco-organisme and accreditation |
|---|---|---|
| Toys (12°) | Toys under article 2 of decree no. 2010-166, models, puzzles and board games. Not writing and drawing articles or electrical toys (WEEE) | Ecomaison, 21 April 2022 to 31 December 2027 |
| Sports and leisure (13°) | Cycles and non-motorised personal transport devices; products for sports and outdoor activities. Not professional-only goods, permanent fixtures on sports grounds or electrical equipment | Ecologic, 31 January 2022 to 31 December 2027 |
| DIY and garden (14°) | Painting and decorating tools; combustion-engine machines; DIY goods including hand tools; products and equipment for gardens. Not professional-only goods, hardware, masonry fittings or electrical equipment | ECODDS (painting and decorating tools), Ecologic (combustion-engine machines), Ecomaison and Valobat (DIY goods and gardens), 2022 to 31 December 2027, Valobat from 1 January 2024. Coordination body OCABJ |
| Building products (4°) | Products and materials integrated permanently into a building and its plot: doors, windows, carpets, parquet, tiles, insulation, coatings | Valobat, Valdelia, Ecominero and Ecomaison, accredited between 30 September and 10 October 2022, all to 31 December 2027. Coordination body OCAB |
| Household chemicals (7°) | Ten categories, from pyrotechnics and fire extinguishers to adhesives, solvents, household biocides and fertilisers | ECODDS (categories 3 to 10), PYRéO (pyrotechnics), EcoPAE (extinguishers, from 1 January 2025), all to 31 December 2027 |
| Lubricants and industrial oils (17°) | Oils likely to become waste oils. Importing equipment that contains oil for the first time does not make you a producer, except for motorised land vehicles such as motor vehicles and non-road mobile machinery | Cyclevia, 24 February 2022 to 31 December 2027 |
| Wipes (21°) | Wipes only, for personal care, cleaning or disinfection, in homes or at work | Citeo Soin & Hygiène, 1 July 2025 to 31 December 2030 |
| Vehicles (15°) | Passenger cars and vans under 3.5 tonnes, and two- and three-wheel motor vehicles and quadricycles | Recycler Mon Véhicule, 8 April 2024 to 31 December 2029, and 20 individual systems of car makers |
| Tyres (16°) | Household and professional tyres. A person that imports products fitted with tyres is also a producer. Not tyres fitted to electrical equipment, toys, sports goods or DIY goods | Aliapur, France Recyclage Pneumatiques (FRP) and Tyval, accredited from 1 January 2024. Coordination body CCCP to 31 December 2028 |
| Boats (18°) | Recreational craft of 2.5 to 24 metres and jet skis, excluding boats propelled by human power | APER, 28 June 2024 to 31 December 2029 |
| Tobacco (19°) | Tobacco products with plastic filters and products intended for use with tobacco products | Alcome, accredited by order of |
| Medical sharps (9°) | Sharps and electronic devices of self-treating patients. The producers are medicine marketing-authorisation holders and device manufacturers or their authorised representative | DASTRI, 1 January 2023 to 31 December 2028 |
| Unused medicines (8°) | Medicines for human use. The producers are marketing-authorisation holders | Cyclamed, 1 January 2022 to 31 December 2027 |
| Chewing gum (20°), fishing gear (22°) | In the Code from 1 January 2024 and 1 January 2025 | ADEME has no scheme page for either |
Fishing gear can be run under an agreement with the environment minister instead of an accreditation (notice of 1 December 2022). Packaging for business buyers is a separate scheme, in full from 1 January 2027, on the packaging page.
France names the seller abroad as a producer in most streams
Article L. 541-10 reaches anyone who makes, handles, sells or imports the products. The ministry’s data order lists the producer statuses of each stream. The status “distance seller from abroad, selling directly to households or to users other than households in France” appears in toys, sports and leisure goods, household chemicals, oils, building products and vehicles. In DIY and garden goods it covers sales to households only. For wipes, ADEME quotes decree no. 2024-1166: a seller established in another EU country or a third country that sells wipes in France by distance contract to private households or other users is a producer. The order lists no such status for tobacco, boats or tyres, whose producers are the makers, importers and first placers on the French market.
What it costs
You pay the eco-organisme an eco-fee on each item you put on the French market. ADEME and the law set no fee for the IDU itself, and article L. 541-10-13 sets no volume below which you need no IDU. The scales are the eco-organismes’ own documents, not law, and they change each year.
- Toys. Ecomaison’s 2026 scale, version of March 2026, excluding tax: EUR 0.08 for a 0.3 kg teddy bear, EUR 0.22 for a 1.5 kg board game, EUR 1.14 for a 5 kg plastic baby walker, EUR 1.20 for a 10 kg wooden game. The rate depends on the product type, weight and materials, and bonuses and penalties adjust it. A company launching fewer than 15,000 items a year, each under 10 kg and under 15 tonnes in total, can use a flat-rate declaration (Ecomaison guide).
- Sports and leisure, and combustion-engine garden machines. Ecologic publishes, for sports and leisure goods, a scale with modulation and a simplified scale, both in force from , and 2027 scales already. For combustion-engine machines it publishes a scale in force from and a simplified scale in force from . ADEME lists bonuses for recycled materials and spare parts, and penalties for slow spare parts and low recyclability (ADEME).
- DIY and garden goods. The Ecologic scale above covers combustion-engine machines. Ecomaison publishes its own product-code and rate generator for DIY and garden goods, valid from 1 January 2026.
- Building products. Valdelia’s 2026 scale and Ecominero, plus Ecomaison.
- Household chemicals. PYRéO for pyrotechnics, and EcoPAE for extinguishers (scale of 1 January 2025).
- Lubricants. Cyclevia lists its scale for each year from 2022 to 2026.
- Wipes. Citeo Soin & Hygiène, 2026 scale guide.
- Vehicles and boats. Recycler Mon Véhicule, 2026 scale and APER, 2026 scale by boat length.
The AGEC law adds other duties on top of the eco-fee
| Duty | What it says | Fine |
|---|---|---|
| Sorting sign and instructions | A product placed on the market for households under the EPR principle carries a sorting sign and the sorting instructions, on the product, the packaging or the papers supplied with it (L. 541-9-3). See Triman | Up to EUR 3,000 (individual) or EUR 15,000 (company), L. 541-9-4 |
| IDU on request, in the sales terms and on the website | The seller gives the buyer, on request, the IDU of the producer that meets the duty for the product (L. 541-10-10). The producer shows its IDU in its general conditions of sale, or in another contract document, and on its website (R. 541-173). See the IDU page | IDU missing where it must appear: up to EUR 30,000, L. 541-9-5 (below) |
| Environmental information | Producers, importers and other businesses putting products on the market that declare more than EUR 10 million of turnover across all the products listed in R. 541-228 on the French market, and put at least 10,000 units of those products a year on it, give the consumer information such as recycled content and recyclability, in electronic form and visible or accessible at purchase (L. 541-9-1, R. 541-227 to R. 541-229). Recycled content applies to the streams of items 3°, 5°, 6°, 7°, 10°, 11° (leather articles excluded), 13°, 14° and 15° (the Code still names 3° although L. 541-10-1 3° is repealed), and to packaging (1°). Recyclability applies to items 1°, 3°, 4°, 5°, 6°, 7°, 10°, 11°, 12°, 13°, 14° and 15° | Up to EUR 3,000 or EUR 15,000, L. 541-9-4-1 |
| No “biodégradable” or “respectueux de l’environnement” | New consumer products and their packaging may not carry these words or an equivalent environmental claim (L. 541-9-1, R. 541-230; decree no. 2022-748 published it as R. 541-223). A product that says it is recycled gives the percentage of recycled material | Up to EUR 3,000 or EUR 15,000, L. 541-9-4-1 |
| Repairability and durability index | Sellers of the equipment categories listed by decree, online sellers included, show the index at purchase (L. 541-9-2). See WEEE | Up to EUR 3,000 or EUR 15,000, L. 541-9-4 |
| Unsold new non-food goods | Producers, importers and distributors reuse, donate or recycle unsold new non-food products, and may not simply discard them (L. 541-15-8). Applies from to products that were already EPR products before and to some other groups, and from to the rest | Up to EUR 3,000 or EUR 15,000, L. 541-15-8 |
| Take-back | See the next section | Fifth-class contravention, R. 541-166 |
The consumer information thresholds are in R. 541-227 and the product list in R. 541-228 (copy in Ineris AIDA; decree no. 2022-748 published them as R. 541-220 and R. 541-221). Its art. 3 puts them in force for every business above them since . Each EUR 3,000 and EUR 15,000 fine, under L. 541-9-4, L. 541-9-4-1 and L. 541-15-8, is an administrative fine under the Consumer Code procedure.
Distance sellers of toys, sports and DIY goods take back used products above EUR 100,000
Article L. 541-10-8 lets the law oblige distributors of EPR products to take back used ones. It applies to toys, sports and leisure goods and DIY and garden goods (L. 541-10-8 V). Article R. 541-158 counts as a distributor anyone who supplies the end user commercially, distance sales included. Under R. 541-160 f the first take-back duty binds a distributor that sells these products with delivery and whose annual turnover from them is above EUR 100,000, or one with a shop floor of at least 200 m2 for them (decree no. 2020-1455). The Ministry dates it from 1 January 2023 for these three streams (Ministry). The same EUR 100,000 applies to furnishing elements and to household chemicals other than pyrotechnics and extinguishers, sold with delivery. Pyrotechnics and fire extinguishers have no threshold (R. 541-160 c), and neither do single-use fuel gas cartridges sold with delivery (R. 541-160 e).
Under L. 541-10-8 I, take-back is limited to the quantity and type of product you sold, or the products it replaces. When you deliver, article R. 541-161 gives you these options:
- Take the used product back at the point of delivery.
- Use a nearby collection point that you finance and organise, or have organised. This works only for products that can be carried without equipment.
- Offer a free return service for the holder, such as the post. This works only where the features of the used product allow it.
- Let the holder send the used product straight to a waste operator under contract with an approved eco-organisme. This works only when that eco-organisme offers it.
You tell the buyer the take-back terms before the sale is concluded (R. 541-163). Below EUR 100,000 of delivered sales, a distance seller has no take-back duty under R. 541-160 f.
A marketplace is the producer when you hold no IDU
A marketplace that facilitates your distance sales meets the EPR duties for them, unless it holds proof that you already have (L. 541-10-9). An IDU for the product counts as that proof. The Ministry says the rule has applied since , and ADEME says a marketplace with no proof has producer status for your quantities. That is why marketplaces ask for your IDU, stream by stream. The register it keeps, and what to type, are on the IDU page. Where a seller does not offer a take-back its sales carry, the marketplace provides it (R. 541-169).
Deadlines
| What | When |
|---|---|
| Appoint a representative in France | From 10 July 2026 (see above) |
| Hold an IDU for each scheme | Since 1 January 2022 (ADEME) |
| Toy eco-fee declaration | Every quarter (Ecomaison guide) |
| Annual data to ADEME | By 31 May for the previous year, sent by the eco-organisme (Service-Public) |
| Take-back, toys, sports and DIY | Since 1 January 2023 (Ministry) |
| Consumer environmental information | Since 1 January 2025 above EUR 10 million and 10,000 units (decree no. 2022-748) |

If you do nothing
Under article L. 541-9-5, the minister notifies you of the facts and the penalty you face, you have one month to answer in writing or orally, and the minister then decides by a reasoned decision. The sanctions are made public (L. 541-9-8).
| Breach | Up to |
|---|---|
| Not registered with ADEME, register not filled in, wrong data, or IDU not shown where it must appear | EUR 30,000, on top of the per-unit fine below |
| Any other EPR breach, except the measures of L. 541-9-1 to L. 541-9-3 and the prescriptions of L. 541-9-6 | EUR 1,500 for an individual or EUR 7,500 for a company, per unit or tonne of product concerned |
| Until you comply | A daily penalty of up to EUR 20,000 |
| Sorting sign or instructions missing, or repairability index missing (L. 541-9-4) | EUR 3,000 for an individual or EUR 15,000 for a company |
| Consumer environmental information duties (L. 541-9-4-1) | EUR 3,000 for an individual or EUR 15,000 for a company |
| Unsold goods destroyed or not reused (L. 541-15-8) | EUR 3,000 for an individual or EUR 15,000 for a company |
| No take-back or no take-back information (R. 541-166) | A fifth-class contravention |
For a breach of the EPR duty itself, the per-unit amount takes into account the estimated average annual quantity you placed on the market over the length of the breach and the maximum unit contribution set by the approved eco-organismes of the stream. The Ministry lists the same three L. 541-9-5 amounts. A producer that joins no eco-organisme and runs no individual system gets no IDU, so it is not registered and the first row applies to it. A failure to appoint a representative falls under “any other EPR breach”: article L. 541-10-9-1 sits in the same section of the Code as article L. 541-9-5, and no text sets a separate fine for it.
What does not apply
- There is no single French EPR number. A seller in toys, sports and wipes holds three IDUs, one for each (IDU page).
- A SIRET is not required of a business not established in France.
- The EUR 30,000 fine has four triggers and no more: not registered, register not filled in, wrong data, IDU not shown.
- The sorting-sign and information duties are fined under their own articles, not under L. 541-9-5.
- The take-back duty does not bind a distance seller below EUR 100,000 of annual turnover from toys, sports and leisure goods, DIY and garden goods, furnishing elements or household chemicals other than pyrotechnics and extinguishers. Pyrotechnics, fire extinguishers and single-use fuel gas cartridges sold with delivery have no threshold.
- Medicines and medical sharps bind marketing-authorisation holders and device makers, not a general retailer of consumer goods.
- Textiles, furniture, packaging, batteries and electrical equipment are not covered here. They have the pages in the first table.
The facts for France, with their sources
| Fact | Value | Source | Checked |
|---|---|---|---|
| Local representative | Yes, in every EPR stream. A person not established in France that is subject to EPR under article L. 541-10 or L. 541-10-9 appoints, by written mandate, a person established in France as representative. The representative takes over every EPR duty named in the mandate. The duty counts as met for products whose EPR duties an operator established in France, named in L. 541-10-9, already fulfils. The article sets no later start date and cites no decree, so the law, published in the Journal officiel no. 159 of 9 July 2026, applies it from 10 July 2026. | Loi no. 2026-602 of 8 July 2026, art. 5 I 2°, inserting Code de l'environnement art. | Registration authority | ADEME registers producers and issues the IDU. Article L. 541-10-1 lists 21 EPR streams in force (item 3° is repealed). ADEME's list of approved schemes shows 19 of them. Chewing gum (20°, from 1 January 2024) and fishing gear containing plastic (22°, from 1 January 2025) have no scheme page there. | Code de l'environnement, art. | Register | SYDEREP, the declaration tool run by ADEME. Article L. 541-10-13 has every producer subject to EPR register with the authority, which issues an IDU, and send it each year proof of membership of an eco-organisme (or of an individual system), the products placed on the market and the waste data, for each product category. The producer may send this through its eco-organisme. The authority publishes the list of registered producers with their IDU. | Code de l'environnement, art. L. 541-10-13 (copy in Ineris AIDA, Livre V, partie législative) | |
| Small-volume threshold | Article L. 541-10-13 sets no volume below which a producer is exempt from registering. In toys, Ecomaison offers a flat-rate declaration to a company that launches fewer than 15,000 items a year, with a maximum unit weight of 10 kg and a total weight under 15 tonnes. It does not take eco-design efforts into account. | Ecomaison, Games & Toys 2026 price guide, version dated March 2026 (document of the eco-organisme, not law) | |
| How the fee is set | Each eco-organisme sets a scale by product type, weight and material, with bonuses and penalties (eco-modulation). Ecomaison's 2026 toys scale, excluding tax and per item: teddy bear, 0.3 kg, EUR 0.08; board game, 1.5 kg, EUR 0.22; baby walker, plastic, 5 kg, EUR 1.14; wooden game, 10 kg, EUR 1.20. | Filing deadline and frequency | Every producer has had to hold an IDU for each EPR scheme since 1 January 2022. The eco-organisme passes the annual data for the previous year to ADEME through SYDEREP by 31 May each year. | Service-Public Entreprendre: Filières à responsabilité élargie du producteur (REP), checked 4 August 2025; ADEME, Filières REP: unique identification numbers (UIN) in EPR schemes | |
| Penalty | Article L. 541-9-5 of the Code de l'environnement. Any EPR breach other than the measures of articles L. 541-9-1 to L. 541-9-3 (fined under L. 541-9-4) and the prescriptions for eco-organismes and individual systems (L. 541-9-6): a fine of up to EUR 1,500 (individual) or EUR 7,500 (company) per unit or tonne of product, and a daily penalty of up to EUR 20,000. On top of that fine, up to EUR 30,000 where a producer subject to EPR is not registered in the register kept by ADEME, has not filled it in, gave wrong data, or did not show its IDU among its mandatory mentions. Missing sorting sign and sorting instructions, or the repairability and durability index: up to EUR 3,000 or EUR 15,000 (L. 541-9-4). Breach of the consumer environmental information duties: up to EUR 3,000 or EUR 15,000 (L. 541-9-4-1). | Code de l'environnement, arts. L. 541-9-4, L. 541-9-4-1 and L. 541-9-5 (copy in Ineris AIDA, Livre V, partie législative) | |
| Enforcement body | The minister in charge of the environment notifies the producer of the facts and the penalty it faces, hears its written or oral observations within one month, and then decides by a reasoned decision. Agents authorised by the minister on the proposal of the director of ADEME record the breaches. The sanctions are made public. Environment, customs and DGCCRF agents may share information to check producers' proof of waste management (L. 541-9 III, as completed by article 4 of the law of 8 July 2026). | Code de l'environnement, arts. | Marketplace can file for you | A person that facilitates distance sales of EPR products for a third party through a marketplace, platform or portal must meet the waste duties for those products, unless it holds proof that the third party already has. Holding an IDU issued for those products under L. 541-10-13 counts as that proof. The marketplace keeps the proof in a register open to the authority. The Ministry states the rule has applied since 1 January 2022. | Code de l'environnement, art. | National rule | The AGEC law is loi no. 2020-105 of 10 February 2020 on the fight against waste and the circular economy. The Ministry lists as its new streams tobacco products, toys, sports and leisure goods, DIY and garden goods, building products and materials, oils, vehicles and wipes. Article L. 541-10-1 adds chewing gum (20°, from 1 January 2024) and fishing gear containing plastic (22°, from 1 January 2025). In toys, sports and leisure goods and DIY and garden goods, ADEME names one or more eco-organismes per stream, accredited to 31 December 2027: Ecomaison for toys, Ecologic for sports and leisure goods, and four organisations for DIY and garden goods. | ADEME, Filières REP: toys (JOUET), sporting and recreational goods (ASL) and home improvement and gardening goods (ABJ); Ministry for the Ecological Transition, anti-waste law for a circular economy (AGEC); Code de l'environnement, art. | National rule | A distance seller based in another EU country or a third country is named a producer for wipes (decree no. 2024-1166 of 5 December 2024, quoted by ADEME). The ministry's data order lists "distance seller from abroad, selling directly to households (or to users other than households) in France" as a producer status in toys, sports and leisure goods, DIY and garden goods (households only), household chemicals, oils, building products and vehicles. | Arrêté of 12 December 2022 on the data of the EPR schemes, annexes V, X to XII, XIII, XVI and XVII (Journal officiel no. 289 of 14 December 2022; copy in Ineris AIDA, status in force) | |
| National rule | Distributors, distance sellers included, take back used toys, sports and leisure goods and DIY and garden goods where they sell with delivery and their annual turnover from those products is above EUR 100,000 (decree no. 2020-1455, art. R. 541-160 f). Failing to take back, or to tell the buyer the terms before the sale, is a fifth-class contravention (R. 541-166). | Decree no. 2020-1455 of 27 November 2020, arts.
