France VAT registration for non-EU sellers (the représentant fiscal)
A business established outside the EU that owes French VAT or must file there has an accredited fiscal representative (représentant fiscal), established in France, appointed before its first French sale. Only one is allowed. A business established in one of the 42 states and territories on the arrêté of 15 May 2013 is exempt: the United Kingdom is on that list and the United States is not. An exempt business deals directly with the Service des impôts des entreprises étrangères (SIEE) at Noisy-le-Grand. Every business files the registration on the business formalities portal; for a business with a representative, the tax office of the representative issues the VAT number. There is no registration threshold. Without a representative, French law makes the customer liable for the VAT and the penalties, but the tax office still assesses the business. One-off representation no longer exists.
A business established outside the EU that owes French VAT appoints one accredited fiscal representative in France before its first French sale. The representative is established in France, is itself liable for VAT and is accredited by its tax office. The duty is in article 289 A, I of the Code général des impôts, and the administration states it in BOFiP. A business established in one of 42 listed states and territories is exempt: the United Kingdom is on the list, the United States is not. No threshold applies. This page is only what France adds to EU VAT registration; the role itself is on fiscal representative, and the other French rules are on the France page. It covers a business with no seat and no permanent establishment in France.
A business outside the EU appoints an accredited fiscal representative
A business is not established in France when it has neither the seat of its activity nor a permanent establishment there. If it is established outside the EU and carries out operations in France that are taxable, or exempt ones such as an intra-EU supply, it appoints a representative. Only one is allowed, for all its operations in France (BOFiP, § 20 and 70).
The representative is a taxable person established in France and known to the tax administration as a VAT payer. It can be your French subsidiary, a French customer or supplier, an approved customs agent or a firm that specialises in the work (§ 80). The appointment is in writing, signed by someone who can bind you. It names both parties and the date it takes effect, and the representative accepts it and undertakes to do your formalities and pay the VAT. The administration publishes a model, BOI-LETTRE-000082 (§ 100). The appointment must come before the French operations and does not run backwards, except where the tax office accepts it in a justified case and the representative undertakes to represent you from the start of the period to regularise (§ 90).
If you appoint nobody, the VAT and the penalties on the taxable operation are due from the customer. The tax office still addresses its assessment to you, as the taxpayer, following a decision of the Conseil d’État of 5 April 2006 (§ 130).
The mandataire à l’international (article 289 A bis) is not a substitute. It is open only to a business that has no French VAT number and whose only French operations are imports with full input-VAT deduction and certain exports and similar exempt operations. A taxable French sale to a buyer is not on its list, so it takes a business out of the scheme (BOFiP BOI-TVA-DECLA-20-30-40-30, § 10-30).
Your country decides whether you need one
A business established in one of these states and territories is exempt: South Africa, Antigua and Barbuda, Armenia, Aruba, Australia, Azerbaijan, Bosnia and Herzegovina, Cape Verde, Curaçao, Dominica, Ecuador, Georgia, Ghana, Grenada, Greenland, the Cook Islands, the Faroe Islands, India, Iceland, Jamaica, Japan, Kenya, Kuwait, North Macedonia, Mauritius, Mexico, Moldova, Nauru, Niue, Norway, New Zealand, Pakistan, French Polynesia, the Republic of Korea, the United Kingdom, Saint-Barthélemy, Saint-Martin, Sint Maarten, Tunisia, Turkey, Ukraine and Vanuatu. The list is in article 1 of the arrêté of 15 May 2013 (archive.org copy of Légifrance, 13 January 2025), and the tax administration’s registration page gives the same 42. The United States is not on it. An older DGFiP page, modified 4 July 2022, names only 24 and leaves out the United Kingdom; the arrêté decides.
The exemption comes from the mutual-assistance instrument that France has with your state (BOFiP, § 35). Two more groups need no representative: a business that makes only supplies under VAT suspension, and one that makes only supplies of gas, electricity, heat or cooling on which the buyer owes the tax (§ 40-50).
An exempt business registers with the Service des impôts des entreprises étrangères (SIEE), part of the Direction des impôts des non-résidents, 10 rue du Centre, 93465 Noisy-le-Grand. It files on the same portal as everyone else. It may name a mandataire established in France to do the formalities under its responsibility; the mandate is exclusive, in French, signed by someone who can bind the business and accepted by the mandataire (impots.gouv.fr).
You register in France when your sale is French
The tax administration lists the operations that call for a French VAT registration for a business with no establishment in France (impots.gouv.fr). The table shows the cases a non-EU seller meets.
| Your case | French registration? |
|---|---|
| Stock in France, sold from your own shop to consumers in France | Yes. You invoice French VAT, file the CA3 return and pay the tax with it. |
| Stock in France, sold to a business that holds a French VAT number | Not for that sale alone. The customer owes the VAT and declares it itself (CGI art. 283-1). If nothing else you do needs a French number, you need no registration (impots.gouv.fr). |
| Stock in France, sold to consumers through a marketplace | Yes, through a representative. The marketplace is treated as buying from you and selling on, and owes the VAT on the sale to the buyer. Your sale to it is exempt, and you keep the right to deduct input VAT (CGI art. 256 V and 262 ter III; BOFiP BOI-TVA-CHAMP-10-10-40-60, § 90 and 160-170; BOI-TVA-DECLA-10-30, § 50). The duty to appoint a representative covers exempt operations as well as taxable ones. |
| Your own stock moved into France from another EU country | Yes, a registration is needed for the intra-EU acquisition, and the CA3 return shows it (BOFiP BOI-TVA-DECLA-20-30-40-10, § 250). A sale from that stock follows the rows above. |
| Your own stock moved out of France to another EU country | Yes. The transfer counts as an intra-EU supply and calls for the CA3 return. |
| Goods shipped to French consumers from your stock in another EU country | Yes, unless the one-stop shop declares the sales. The exception for a business established in one EU country with under EUR 10,000 of sales is not open to you. If a marketplace facilitates the sale, it is the deemed supplier here too: it is treated as buying from you and selling on, as for stock in France (BOFiP BOI-TVA-CHAMP-10-10-40-60, § 160-170). See VAT OSS. |
| You import goods into France and account for the import VAT yourself on your VAT return | Yes. Self-assessing import VAT is among the operations for which French registration has been compulsory since 1 January 2022 (impots.gouv.fr). |
| Parcels shipped from outside the EU to a French consumer who is the importer | Not by default. The sale is an export, and the buyer pays the import VAT (impots.gouv.fr). In detail: a marketplace that facilitates the sale owes the import VAT (CGI art. 293 A; BOFiP BOI-TVA-DECLA-10-30, § 10 and 30). With no marketplace, a parcel of EUR 150 or less may go through IOSS. If you use neither a marketplace nor IOSS, the recipient of the goods owes the import VAT. You may instead opt under CGI art. 293 A quater, II-1 to owe the import VAT yourself. The sale is then located in France and you account for French VAT, so you register (BOFiP BOI-TVA-DECLA-10-20, § 40-60). |
The general cases are in EU VAT registration and EU VAT for online sellers.
If you have no taxable French operations and only paid French VAT on costs, you do not register. You claim the VAT back, and a business outside the EU does so through an accredited fiscal representative too. The representative files the claim electronically, in French and in euros, with a minimum of EUR 400 for a quarterly claim and EUR 50 for an annual one, and no later than 30 June of the year after the period (impots.gouv.fr).
No threshold applies to you
France has no registration threshold for a business with its seat outside the EU and no establishment in France. The franchise en base of article 293 B is open to a business established in France, to a business with its seat outside the EU and a permanent establishment in France that chooses to be attached to France, and to a business established in another EU country that has told its own state it wants to use it in France (BOFiP, § 5-15; BOI-TVA-DECLA-40-15, § 220). A seller outside the EU is none of these. The EU rule is in VAT OSS.
How you register, in order
- Choose the representative and have it accredited. The representative asks its own tax office (SIE) for an accreditation, one for each business it represents, with its company number, a description of its staff and means, a recent criminal-record extract, proof of solvency or a financial guarantee, your name, address and activities, and the two signed designation documents. To be accredited it is established in France and liable for VAT, neither it nor its managers has committed a serious or repeated tax offence, and it shows solvency in line with its duties or a guarantee of a quarter of the sums arising from them. Where that level cannot be set, the guarantee is EUR 10,000 (BOFiP BOI-TVA-DECLA-20-30-40-10, § 140-170).
- File the creation declaration on the business formalities portal. It is filed electronically at formalites.entreprises.gouv.fr, on the foreign-business form (EE0) (BOFiP; impots.gouv.fr). You can give the representative an express mandate to file it. The representative’s accreditation number goes into the declaration (§ 280).
- Attach the papers. For every business: a copy of the certificate of entry in the commercial register or equivalent in your country, a certificate of liability to VAT in the country of your seat where there is one, and the letter designating the representative. A sole trader adds proof of identity (identity card, passport, or birth certificate with a free translation that the trader certifies). A legal entity adds its articles of association or founding documents with a French translation (§ 285). The translation rules are in the next paragraph.
- Receive the VAT number. After INSEE registers you, the tax office of the representative gives you a VAT identification number. The representative declares your operations under it and its own under its own number (§ 280). The welcome letter, with your filing duties, goes to the representative by e-mail. Give a bank account in SEPA format: only such an account lets the tax office refund a VAT credit (impots.gouv.fr).
A free translation of the main elements of the statutes (legal form, partners, manager, share capital, corporate purpose) is accepted where the statutes are written in the language of an EU country. Otherwise a sworn translation into French is required (impots.gouv.fr). Your VAT number is separate from your EORI number and your IOSS number. The EORI is on the EORI guide, and the VAT number itself on what a VAT number is.
The representative answers for your French VAT
The representative is responsible for the VAT duties on all your operations in France, including those it did not know of, for as long as the appointment is valid. It files the returns, including nil returns, and pays the tax when operations are taxable. A business that has named a representative also files the recapitulative statement of customers (article 289 B). The representative keeps the accounts of your French operations. You may keep them yourself, but the representative must be able to show the books and the supporting papers whenever the tax office asks. When the representative issues an invoice, it states that it acts as your representative; when you issue it, the invoice shows the representative’s name and address, so that a business customer can deduct the VAT (BOFiP BOI-TVA-DECLA-20-30-40-10, § 210-260).
The appointment lasts until the tax office is told it has ended. If you stop having taxable French operations, you end it and the representative tells the SIE in writing without delay. If the representative wants out, it informs you and the SIE in writing. The end takes effect no earlier than the date the administration is notified, and the SIE then withdraws the accreditation (§ 110-120 and 190).
You file and pay in France
| Duty | Due |
|---|---|
| VAT return (CA3), monthly | With the payment, between the 15th and the 24th of the following month. The day depends on the legal form of the business and its place, as BOFiP’s table sets it. A return showing imports is due on the 24th. A deadline on a public holiday moves to the next working day (BOI-TVA-DECLA-20-20-10-10, § 190-220). |
| VAT return (CA3), quarterly | Allowed where the VAT due for the year is below EUR 4,000 (§ 10). A period with no operations still needs a nil return (§ 200). |
| Transaction data (e-reporting) | For operations on which you owe French VAT: from 1 September 2026 for large and mid-sized companies, from 1 September 2027 for micro, small and medium companies; for taxable intra-EU acquisitions, from 1 September 2027 whatever the size. You choose an approved platform before your start date, and it sends the data. The size counts the whole foreign legal entity (impots.gouv.fr; BOI-TVA-DECLA-20-30-50, § 10). |
| Union OSS return, if you use it | Filed with the country where you are registered for the scheme. See VAT OSS. |
E-reporting covers sales to consumers that are subject to French VAT, as daily totals by VAT rate, and sales located in France to another business that is not established in France. Exempt operations, such as exports and intra-EU supplies, and imports are left out, and so is a sale to a consumer if you are registered with a European VAT one-stop shop. Payment data is sent for services and for deposits on goods. The duty covers only operations on which you owe French VAT. Taxable intra-EU acquisitions in France, and other purchases on which you owe the VAT as the buyer, are reported from 1 September 2027 whatever your size. The platform does the sending (impots.gouv.fr).
What happens if you do nothing
The VAT is due whether or not you appointed anyone. The customer owes it with the penalties, and the tax office still assesses you. The other consequences:
| Breach | Consequence |
|---|---|
| No representative appointed | The VAT and the related penalties are due from the customer, and the assessment still goes to you (BOFiP, § 130). |
| Return filed late, or not at all, with tax due | An increase of 10 percent if there is no formal notice or you file within 30 days of one, 40 percent if you do not file within 30 days of a formal notice, and 80 percent if hidden activity is discovered (CGI art. 1728, § 20). |
| Return with nothing to pay filed late | A fine of EUR 150 for each document. There is no fine for a first offence in the current year and the three before it, if you put it right on your own or within 30 days of a request (CGI art. 1729 B, § 10, 40 and 80). |
| Paying late or in part | An increase of 5 percent of the sum paid late, not applied when a late return comes with full payment, plus interest of 0.20 percent for each month (CGI art. 1731 and 1727, § 140-180). |
| Your representative fails to file or pay | The SIE withdraws its accreditation after letting it answer within 30 days, and can start against the representative the procedure of article L. 10 BA of the Livre des procédures fiscales, which can lead to suspension of the representative’s VAT number (BOFiP, § 205). |
The one-off fiscal representative no longer exists. Article 112 of the finance law no. 2023-1322 of repealed it, in force from . The administration let the old VAT numbers of one-off representatives stay valid until , and let a business that applied for registration before that date use a one-off representative until it receives its French VAT number (BOFiP, § 5). An importer not established in France that imports goods and then makes an exempt intra-EU supply of them names its representative as the consignee on the import declaration (§ 30).
The facts for France, with their sources
| Fact | Value | Source | Checked |
|---|---|---|---|
| Local representative | A business established outside the EU that owes VAT, or must meet filing duties in France, has a VAT-registered representative established in France accredited. The representative does its formalities and pays the tax in its place. Only one representative is allowed for all its operations in France. The duty covers taxable operations and exempt ones. | BOFiP-Impôts, BOI-TVA-DECLA-20-30-40-10 (version in force from 11 February 2026): the fiscal representative, CGI art. 289 A, I | |
| Local representative | Exempt from the representative: a business established in a non-EU state with which France has a mutual-assistance instrument of the kind in Directive 2010/24/EU and Regulation (EU) No 904/2010, listed in the arrêté of 15 May 2013 (42 states and territories, among them the United Kingdom, India, Japan, Australia, Norway and Turkey, and not the United States). | impots.gouv.fr, Immatriculation à la TVA (modified 3 March 2025): the list of non-EU states whose businesses need no fiscal representative | |
| Local representative | Two more groups of businesses established outside the EU are exempt from the representative: a business that makes only supplies under VAT suspension (CGI art. 277 A, I), and one that makes only supplies of natural gas, electricity, heat or cooling on which the buyer owes the tax (CGI art. 283, 2 quinquies). The exemption for the listed states rests on the mutual-assistance instrument that France has with the state. | BOFiP-Impôts, BOI-TVA-DECLA-20-30-40-10 (version in force from 11 February 2026), § 35-50 | |
| Registration authority | A business with its seat in the EU or in one of the 42 listed states deals with the Service des impôts des entreprises étrangères (SIEE) of the Direction des impôts des non-résidents (DINR), 10 rue du Centre, 93465 Noisy-le-Grand. Every other non-EU business deals with the Service des impôts des entreprises that the representative already files with, except that one which owes withholding tax for an employee in France deals with the SIEE instead. | impots.gouv.fr, Immatriculation à la TVA (modified 3 March 2025): competent tax office | |
| Register | The business files its creation declaration, with the supporting documents, electronically on the business formalities portal (guichet des formalités des entreprises, formalites.entreprises.gouv.fr). INSEE registers it; the tax office of the representative then gives the business a VAT identification number, which the representative uses to declare the business's operations. | BOFiP-Impôts, BOI-TVA-DECLA-20-30-40-10 (version in force from 11 February 2026), § 280 | |
| Small-volume threshold | None for a business with its seat outside the EU and no establishment in France. The franchise en base (CGI art. 293 B) is open to a business established in France, to one that has its seat outside the EU and a permanent establishment in France and chooses to be attached to France, and to a business established in another EU country that has notified its intention in that state. | BOFiP-Impôts, BOI-TVA-DECLA-40-10-10 (version in force from 1 July 2026), § 5-15 | |
| Filing deadline and frequency | Under the normal real regime the VAT return (CA3) is filed monthly, with the tax paid at the same time. A business whose annual VAT is below EUR 4,000 may file quarterly. A return with no operations is still filed, as a nil return. The deadline falls between the 15th and the 24th of the following month, by the legal form and the place of the business; a return showing imports is due on the 24th. | BOFiP-Impôts, BOI-TVA-DECLA-20-20-10-10 (version in force from 18 January 2023), § 10, 190-200 and the table of deadlines | |
| Filing deadline and frequency | A foreign business with no establishment in France sends its transaction data (e-reporting) to the tax administration through an approved platform, for the operations on which it owes French VAT. For its sales, the duty starts on 1 September 2026 for large and mid-sized companies and on 1 September 2027 for micro, small and medium companies. For taxable intra-EU acquisitions in France and other purchases on which it owes the VAT as buyer, it starts on 1 September 2027 whatever the size. The size is that of the whole foreign legal entity. | impots.gouv.fr, e-reporting for foreign companies with no permanent establishment in France; BOFiP BOI-TVA-DECLA-20-30-50 (30 September 2026), § 10 | |
| Penalty | Filing a return late, or not at all, when tax is due: an increase of 10 percent (no formal notice, or filed within 30 days of one), 40 percent (not filed 30 days after a formal notice) or 80 percent (hidden activity discovered, no notice needed) (CGI art. 1728). | BOFiP-Impôts, BOI-CF-INF-10-20-10 (version in force from 8 March 2017), § 20 | |
| Penalty | A return filed late when it shows no tax due, such as a nil or credit VAT return: a fine of EUR 150 for each document not filed on time (CGI art. 1729 B, 1). No fine applies to a first offence in the current calendar year and the three before it, if you put it right on your own or within 30 days of a request from the administration (art. 1729 B, 3). | BOFiP-Impôts, BOI-CF-INF-10-40-10 (version in force from 6 December 2017), § 10, 40 and 80; BOI-CF-INF-10-20-10, § 10 | |
| Penalty | Paying VAT late or in part: an increase of 5 percent of the sum paid late (CGI art. 1731), not applied when a late return comes with full payment, plus late-payment interest of 0.20 percent for each month (CGI art. 1727). | BOFiP-Impôts, BOI-CF-INF-10-30 (version in force from 11 December 2019), § 140-180 | |
| Enforcement body | The tax office (SIE) of the representative accredits it. It can withdraw the accreditation if the representative no longer meets a condition, and withdraws it if the representative fails to file or pay for the business it represents. In the second case the office can also start against the representative the procedure of article L. 10 BA of the Livre des procédures fiscales, which can lead to suspension of the representative's VAT number. | BOFiP-Impôts, BOI-TVA-DECLA-20-30-40-10 (version in force from 11 February 2026), § 140, 200 and 205 | |
| Language of filing | The statutes go in with a French translation. A free translation of the main elements (legal form, partners, manager, share capital, corporate purpose) is accepted where the statutes are written in the language of an EU country; otherwise a sworn translation into French is required. | impots.gouv.fr, Is it possible to send a copy of statutes written in a foreign language without a French translation? (modified 4 July 2022) | |
| National rule | Where a seller not established in the EU sells goods located in France to a buyer who is not a taxable person through a marketplace, the marketplace is treated as having bought and resold the goods and owes the VAT on the sale to the buyer. The seller's own sale to the marketplace is exempt without loss of the right to deduct (CGI art. 256 V and art. 262 ter, III). | BOFiP-Impôts, BOI-TVA-CHAMP-10-10-40-60 (version in force from 18 January 2023), § 90 and 160-170 | |
