Machinery Directive 2006/42/EC: what applies to the machines you sell until 20 January 2027
You sell power tools, garden machines, 3D printers or e-bikes into the EU, and the machinery law that covers them changes on 20 January 2027.
Machinery placed on the EU market before 20 January 2027 follows the Machinery Directive, and from that date the Machinery Regulation (Art. 54Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 54Click opens the article on EUR-Lex.). The manufacturer assesses it, documents it and affixes the CE marking before sale (Machinery Directive Art. 5(1)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 5, paragraph 1Click opens the article on EUR-Lex.; Art. 10(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 2Click opens the article on EUR-Lex.).
Machinery is an assembly of linked parts, at least one of which moves, fitted with a drive system other than human or animal effort and joined for a specific application; power tools, lawnmowers, chainsaws and, from 20 January 2027, 3D printers are examples (Art. 3(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 1Click opens the article on EUR-Lex., Art. 2(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 2, paragraph 2Click opens the article on EUR-Lex.; Machinery Directive Art. 2(a)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 2, point (a)Click opens the article on EUR-Lex.). A unit placed on the EU market before 20 January 2027 must meet Directive 2006/42/EC and may still be sold after that date; a unit not yet placed by then must meet the Machinery Regulation (EU) 2023/1230, which applies from 20 January 2027 as the Directive is repealed (Art. 51(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 51, paragraph 2Click opens the article on EUR-Lex., Art. 52(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 52, paragraph 1Click opens the article on EUR-Lex., Art. 54Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 54Click opens the article on EUR-Lex.). The Commission's Blue Guide, which is guidance and not law, counts a unit still in the manufacturer's or importer's own stock as not yet placed (section 2.3). Under both, the manufacturer meets the essential health and safety requirements, draws up the technical file, runs the conformity assessment, draws up the declaration of conformity and affixes the CE marking before placing the machine on the market (Machinery Directive Art. 5(1)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 5, paragraph 1Click opens the article on EUR-Lex.; Art. 10(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 1Click opens the article on EUR-Lex., Art. 10(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 2Click opens the article on EUR-Lex.). Under the Regulation that manufacturer includes any business that has the machine made and sells it under its own name or trademark (Art. 3(18)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 18Click opens the article on EUR-Lex., Art. 17Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 17Click opens the article on EUR-Lex.). Machines on the high-risk list, such as portable chainsaws and woodworking circular saws, may need a notified body. From 2027 a machine on Part A of the list always needs one, and a machine on Part B, chainsaws included, needs one too unless it is built to harmonised standards or common specifications for its category under the Regulation, and none were published as of 5 October 2026 (Machinery Directive Art. 12Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 12Click opens the article on EUR-Lex.; Art. 25(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 25, paragraph 2Click opens the article on EUR-Lex., Art. 25(3)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 25, paragraph 3Click opens the article on EUR-Lex.). From 20 January 2027 an importer checks all of that before selling and adds its own name and address, and a distributor checks the CE marking, the declaration and the instructions (Art. 13Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 13Click opens the article on EUR-Lex., Art. 15Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 15Click opens the article on EUR-Lex.). The instructions may then be digital, with paper free of charge on request at the time of purchase and the essential safety information always on paper for non-professional users (Art. 10(7)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 7Click opens the article on EUR-Lex.).

What you do:
- Settle whether your product is machinery. It is if a motor or other drive system, not muscle, moves at least one of its linked parts to do a specific job (Art. 3(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 1Click opens the article on EUR-Lex.; Art. 2(a)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 2, point (a)Click opens the article on EUR-Lex.). Power tools, lawnmowers, chainsaws and pedal-assist e-bikes up to 250 W, whose motor stops when you stop pedalling and before 25 km/h, are machinery. From 20 January 2027, so are 3D printers (Art. 2(2)(p)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 2, paragraph 2, point (p)Click opens the article on EUR-Lex., point (iv)). Interchangeable equipment, safety components, lifting accessories, lifting chains, ropes and webbing, removable mechanical transmission devices and partly completed machinery are covered too (Art. 2(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 2, paragraph 1Click opens the article on EUR-Lex.).
- Settle which law each unit follows. A unit placed on the EU market before must meet the Machinery Directive, and it may still be sold after that date. A unit placed on the market from 20 January 2027 must meet the Machinery Regulation (Art. 51(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 51, paragraph 2Click opens the article on EUR-Lex., Art. 52(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 52, paragraph 1Click opens the article on EUR-Lex., Art. 54Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 54Click opens the article on EUR-Lex.). Each unit counts on its own, so a new shipment of an old model placed from that date follows the Regulation. A unit still in your own stock as its manufacturer or importer on that date has not been placed yet; sold from 20 January 2027, it must meet the Regulation (Blue Guide, section 2.3, Commission guidance).
- Work out your role. Under the Regulation, your name or trademark on the machine makes you its manufacturer, whoever built it. Based in the EU and bringing in a machine from outside the EU, you are the importer. Reselling it unchanged, you are a distributor (Art. 3(18)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 18Click opens the article on EUR-Lex., Art. 3(20)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 20Click opens the article on EUR-Lex., Art. 3(21)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 21Click opens the article on EUR-Lex., Art. 17Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 17Click opens the article on EUR-Lex.).
- As the manufacturer, before the first unit goes on sale: run a risk assessment, design the machine to the essential health and safety requirements, compile the technical file, carry out the conformity assessment, sign the declaration of conformity and affix the CE marking (Art. 5(1)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 5, paragraph 1Click opens the article on EUR-Lex.; Art. 10(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 1Click opens the article on EUR-Lex., Art. 10(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 2Click opens the article on EUR-Lex.). An outdoor machine such as a lawnmower, lawn trimmer, hedge trimmer, leaf blower or chainsaw also carries its guaranteed sound power level next to the CE marking (Directive 2000/14/EC, Art. 11(2), 12, 13).
- Look the machine up on the high-risk list: portable chainsaws, woodworking circular saws, band-saws and planers, presses, vehicle lifts and a few more. These may need a notified body. From 20 January 2027 a machine on Part A of the list always needs one. A machine on Part B, chainsaws and saws included, needs one too unless it is built to harmonised standards or common specifications for its category under the Regulation, and none were published as of 5 October 2026 (Art. 12Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 12Click opens the article on EUR-Lex.; Art. 25(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 25, paragraph 2Click opens the article on EUR-Lex., Art. 25(3)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 25, paragraph 3Click opens the article on EUR-Lex.).
- As the importer, for units placed from : before selling, make sure the conformity assessment was done, the technical documentation exists, the machine carries the CE marking, the declaration and the instructions, and the manufacturer’s name and address are on it. Add your own name, postal address and website or email, and keep the declaration for 10 years (Art. 13(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 13, paragraph 2Click opens the article on EUR-Lex., Art. 13(3)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 13, paragraph 3Click opens the article on EUR-Lex., Art. 13(4)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 13, paragraph 4Click opens the article on EUR-Lex., Art. 13(8)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 13, paragraph 8Click opens the article on EUR-Lex.). Before that date, where the manufacturer is outside the EU, you are the EU operator the machine must name: you verify that the declaration and the technical documentation exist, keep the declaration for the authorities, and put your name and postal address on the machine, its packaging, the parcel or an accompanying document (Art. 4(2)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 2Click opens the article on EUR-Lex., Art. 4(3)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 3Click opens the article on EUR-Lex., Art. 4(4)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 4Click opens the article on EUR-Lex. of Regulation (EU) 2019/1020).
- As a distributor, for units placed from : before selling, verify the CE marking, the declaration, instructions in the language the country of sale requires, and the manufacturer’s and importer’s details (Art. 15(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 15, paragraph 2Click opens the article on EUR-Lex.).
- Get the instructions right. Under the Directive they go with the machine, in the language of the EU country where it is sold, and a translation goes with the original (Art. 5(1)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 5, paragraph 1Click opens the article on EUR-Lex., point (c); Annex I, section 1.7.4). Under the Regulation they may be digital, but a buyer who asks at the time of purchase gets paper free of charge within one month, and a machine that consumers may use always comes with its essential safety information on paper (Art. 10(7)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 7Click opens the article on EUR-Lex.).
- For a machine consumers may use, show on your listing the manufacturer’s name and postal and electronic address, the EU contact where the manufacturer is outside the EU, a picture and the type of the machine, and its warnings and safety information (Art. 19Regulation (EU) 2023/988, General Product Safety RegulationArticle 19Click opens the article on EUR-Lex., Art. 3(1)Regulation (EU) 2023/988, General Product Safety RegulationArticle 3, point 1Click opens the article on EUR-Lex.).
What counts as machinery
Both laws define machinery the same way at the core: an assembly, fitted with or intended to be fitted with a drive system other than directly applied human or animal effort, made of linked parts or components, at least one of which moves, joined together for a specific application (Art. 3(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 1Click opens the article on EUR-Lex., point (a); Art. 2(a)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 2, point (a)Click opens the article on EUR-Lex.). Four variants count too: an assembly missing only the parts that connect it on site or to its power source; one that works only once mounted on a vehicle or installed in a building; several machines arranged and controlled to work as one; and a lifting device powered only by human effort. The Regulation adds a fifth: an assembly missing only the software for its specific application (Art. 3(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 1Click opens the article on EUR-Lex., points (b) to (f)).
| Product | Machinery? | Why |
|---|---|---|
| Cordless or corded drill, saw, sander | Yes | A drive system and moving parts doing one job. The harmonised standards for hand-held power tools, EN 62841-2-1 for drills among them, are listed under the Machinery Directive. |
| Petrol lawnmower, robotic lawnmower, lawn trimmer | Yes | Their harmonised standards, EN ISO 5395, EN 50636-2-107 and EN 50636-2-91, are listed under the Machinery Directive. |
| Chainsaw | Yes, and on the high-risk list | Portable chainsaws for woodworking are named in Annex IV of the Directive and Annex I, Part B, of the Regulation. |
| 3D printer | From 20 January 2027, yes | The Machinery Regulation, not this Directive, makes it machinery: see Machinery Regulation. |
| E-bike with pedal assistance, motor up to 250 W, cutting out when you stop pedalling and before 25 km/h | Yes | The EU vehicle approval rules leave it out (Regulation (EU) No 168/2013, Art. 2(2)(h)), and its harmonised standard, EN 15194, is listed under the Machinery Directive. That standard gives no presumption of conformity for the vibration requirements, Annex I, sections 1.5.9 and 3.6.3.1, of the Directive, so compliance with those must be shown another way. |
| Faster e-bike, moped or motorcycle | No, where Regulation (EU) No 168/2013 covers it | Two- and three-wheel vehicles within Regulation (EU) No 168/2013 are excluded (Art. 2(2)(h)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 2, paragraph 2, point (h)Click opens the article on EUR-Lex.; Art. 1(2)(e)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 1, paragraph 2, point (e)Click opens the article on EUR-Lex., which names Directive 2002/24/EC, now read as Regulation (EU) No 168/2013 under its Art. 81(2)). That Regulation itself leaves out vehicles mainly for off-road use, self-balancing vehicles and vehicles with no seat (Art. 2(2)(g), (i) and (j)). Those are not excluded from the machinery laws and can be machinery. |
| E-bike charger sold on its own | No | It has no moving parts doing a job, so it does not meet the definition. As mains electrical equipment it is under the Low Voltage Directive (Directive 2014/35/EUDirective 2014/35/EU, Low Voltage Directive (consolidated text of 30 May 2026)The whole regulationClick opens the law on the EU Publications Office., Art. 1Directive 2014/35/EU, Low Voltage Directive (consolidated text of 30 May 2026)Article 1Click opens the article on EUR-Lex.); see CE marking. The e-bike’s battery has its own law: EU Battery Regulation. |
| Household appliance for domestic use, audio and video, IT equipment | No: under the Directive where the low-voltage Directive covers it; under the Regulation where the low-voltage or radio Directive covers it | Excluded by both laws (Art. 1(2)(k)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 1, paragraph 2, point (k)Click opens the article on EUR-Lex.; Art. 2(2)(p)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 2, paragraph 2, point (p)Click opens the article on EUR-Lex.). From 20 January 2027 electrically operated furniture is not part of that exclusion (Art. 2(2)(p)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 2, paragraph 2, point (p)Click opens the article on EUR-Lex., point (i)). |
| Hand tool with no motor | No | No drive system other than human effort. A manual hoist or other lifting device is the exception (Art. 3(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 1Click opens the article on EUR-Lex., point (e)). The Commission’s guide to the Directive, which is guidance and not law, adds that a machine driven by human effort stored in a spring or a hydraulic or pneumatic accumulator, so that it runs after the effort stops, is covered (Guide, edition 2.3, §35). |
The standards named in the table are in Implementing Decision (EU) 2023/1586, Annex I, Part Three: rows 204 to 206 (combustion-engine lawnmowers), 495a (EN 15194:2017+A1:2023, electrically power assisted cycles, listed with that restriction on vibration), 627 (lawn trimmers), 631 (robotic lawnmowers) and 672 (drills).
The laws also cover five related products (Art. 2(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 2, paragraph 1Click opens the article on EUR-Lex.):
- Interchangeable equipment: a device the operator fits to a machine or tractor to change its function or add one, as long as it is not a tool (Art. 3(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 2Click opens the article on EUR-Lex.).
- Safety components: a physical or digital component, software included, sold separately, that fulfils a safety function and whose failure endangers people, but which the product does not need in order to work, or which normal components can replace for it to work (Art. 3(3)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 3Click opens the article on EUR-Lex.). Annex II lists examples: emergency stop devices, two-hand controls, guards, presence-sensing devices, and software ensuring safety functions.
- Lifting accessories: slings and other gear placed between a lifting machine and its load, or on the load, and sold separately (Art. 3(5)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 5Click opens the article on EUR-Lex.).
- Chains, ropes and webbing made for lifting (Art. 3(6)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 6Click opens the article on EUR-Lex., Art. 3(7)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 7Click opens the article on EUR-Lex., Art. 3(8)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 8Click opens the article on EUR-Lex.).
- Removable mechanical transmission devices: the shaft that carries power from a tractor or self-propelled machine to another machine (Art. 3(9)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 9Click opens the article on EUR-Lex.).
Partly completed machinery is an assembly that cannot do a specific job on its own and is only meant to be built into a machine (Art. 3(10)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 10Click opens the article on EUR-Lex.). The Directive names a drive system as an example (Art. 2(g)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 2, point (g)Click opens the article on EUR-Lex.). These laws ask no CE marking of it. Its manufacturer draws up a declaration of incorporation and assembly instructions instead (Art. 13Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 13Click opens the article on EUR-Lex.; Art. 11Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 11Click opens the article on EUR-Lex.).
What sits outside both laws
The Regulation does not apply to, among others (Art. 2(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 2, paragraph 2Click opens the article on EUR-Lex.):
- safety components that replace identical ones, supplied as spare parts by the maker of the original machine;
- equipment for fairgrounds and amusement parks;
- weapons, firearms included;
- motor vehicles and their trailers, two- and three-wheel vehicles and quadricycles, and agricultural and forestry tractors, with their systems and parts, except machinery mounted on them;
- means of transport by air, on water and on rail networks, except machinery mounted on them;
- machinery designed for military or police purposes, or for temporary use in research laboratories;
- household appliances for domestic use other than electrically operated furniture, audio and video equipment, IT equipment, ordinary office machinery other than 3D printers, low-voltage switchgear and electric motors, where the low-voltage or radio Directive covers them.
The Directive’s list is close to it (Art. 1(2)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 1, paragraph 2Click opens the article on EUR-Lex.). Where a more specific EU law covers some of a machine’s risks, that law governs those risks and the machinery law does not (Art. 9Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 9Click opens the article on EUR-Lex.; Art. 3Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 3Click opens the article on EUR-Lex.).
A non-compliant machine may be shown at a trade fair or demonstration if a visible sign says it does not comply and will not be sold until it does (Art. 4(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 4, paragraph 2Click opens the article on EUR-Lex.; Art. 6(3)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 6, paragraph 3Click opens the article on EUR-Lex.).
What changes on 20 January 2027
The Directive is repealed on , and a unit placed on the EU market before that date may still be sold after it (Art. 51(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 51, paragraph 2Click opens the article on EUR-Lex., Art. 52(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 52, paragraph 1Click opens the article on EUR-Lex., Art. 54Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 54Click opens the article on EUR-Lex.). A unit placed from that date follows the Regulation: the dates, the side-by-side differences, the importer and distributor duties and the Annex I routes are in Machinery Regulation.
The corrigendum of 4 July 2023 corrected the date in the Official Journal text from 14 January 2027 to 20 January 2027. “Placed on the market” means the first time a unit is made available in the EU (Art. 3(12)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 12Click opens the article on EUR-Lex.), counted unit by unit; the Blue Guide, section 2.3, counts a unit still in the manufacturer’s or importer’s own stock as not yet placed. That is Commission guidance, not law.
Which role you hold
- Manufacturer: makes a product in scope, or has it designed or made, and markets it under its own name or trademark; or makes one and puts it into service for its own use (Art. 3(18)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 18Click opens the article on EUR-Lex.).
- Authorised representative: established in the EU, holds a written mandate from the manufacturer for specified tasks (Art. 3(19)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 19Click opens the article on EUR-Lex.).
- Importer: established in the EU, places a product from a non-EU country on the EU market (Art. 3(20)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 20Click opens the article on EUR-Lex.).
- Distributor: anyone else in the supply chain who makes the product available on the market (Art. 3(21)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 21Click opens the article on EUR-Lex.). A marketplace seller reselling branded machines is usually here.
An importer or distributor that sells under its own name or trademark, or modifies a machine already on the market in a way that can affect compliance, carries every manufacturer duty (Art. 17Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 17Click opens the article on EUR-Lex.). Anyone who substantially modifies a machine becomes its manufacturer for that machine, unless it is a non-professional user modifying its own machine for its own use (Art. 18Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 18Click opens the article on EUR-Lex.).
Under the Directive the duties sit with the manufacturer or its authorised representative (Art. 5(1)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 5, paragraph 1Click opens the article on EUR-Lex.). Its definition of manufacturer covers anyone who designs and/or manufactures machinery and is responsible for its conformity with a view to placing it on the market under its own name or trademark, and, where there is no such manufacturer, whoever places the machine on the market or puts it into service (Art. 2(i)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 2, point (i)Click opens the article on EUR-Lex.). Unlike the Regulation, it has no words for a business that has the machine designed or made by others. The Commission’s guide to the Directive, which is guidance and not law, reads it to cover that business too: design or construction “may be carried out by other persons (suppliers or sub-contractors)”, and the person placing the machine on the market under its own name must control their work (Guide, edition 2.3, §79). Where no original instructions exist in the language of the country where the machine will be used, the translation may come from the manufacturer, its authorised representative “or by the person bringing the machinery into the language area in question” (Annex I, section 1.7.4.1, point (b)).
What each role owes
The manufacturer builds the safety in and proves it; the importer makes sure the proof exists before the machine enters the EU; the distributor checks what is on the machine and in the box. The duty-by-duty table for units placed from 20 January 2027 is in Machinery Regulation.
How it reaches a business outside the EU
An online offer counts as making a product available in the EU when it is targeted at end users there (Art. 6Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 6Click opens the article on EUR-Lex. of Regulation (EU) 2019/1020Regulation (EU) 2019/1020, Market Surveillance RegulationThe whole regulationClick opens the law on the EU Publications Office.). A business outside the EU that sells machines under its own brand is their manufacturer, wherever it sits.
A machine under the Machinery Directive may be placed on the market only if an economic operator established in the EU answers for it: the EU manufacturer, the importer, an authorised representative with a written mandate, or, where none of those exists, an EU fulfilment service provider (Art. 4(1)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 1Click opens the article on EUR-Lex., Art. 4(2)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 2Click opens the article on EUR-Lex., Art. 4(5)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 5Click opens the article on EUR-Lex.). From 20 January 2027 that rule carries over, because references to the repealed Directive are read as references to the Regulation (Art. 51(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 51, paragraph 2Click opens the article on EUR-Lex.). Who can hold the EU role is the EU Responsible Person.
In Great Britain the rules are the Supply of Machinery (Safety) Regulations 2008, which implemented the Machinery Directive in the United Kingdom (S.I. 2008/1597, explanatory note).
Which machines need a notified body
Under the Directive (Art. 12Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 12Click opens the article on EUR-Lex.):
- A machine not on Annex IV: internal checks by the manufacturer, Annex VIII. No outside body.
- A machine on Annex IV, built to harmonised standards that cover all its essential requirements: internal checks, EC type-examination, or full quality assurance, at the manufacturer’s choice.
- A machine on Annex IV without such standards: EC type-examination or full quality assurance, both through a notified body.
From the Regulation sorts machines by Annex I, Part A and Part B instead. The routes, and the categories an online seller meets most, are in Machinery Regulation.
The categories are in Annex IV of the Directive. The Commission’s machinery page points to the NANDO database for the bodies notified under either law; how to choose one is in Notified body.
A machine built to a harmonised standard published in the Official Journal is presumed to meet the requirements that standard covers (Art. 20(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 20, paragraph 1Click opens the article on EUR-Lex.; Art. 7(2)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 7, paragraph 2Click opens the article on EUR-Lex.). EN ISO 12100 is the general standard on risk assessment and risk reduction. It is listed under the Directive as an A-type standard, and the list itself says that applying such standards alone “does not give a full presumption of conformity” (Implementing Decision (EU) 2023/1586, Annex I, Part One). The standards written for one category of machine, such as those for drills or lawnmowers, are C-type standards, listed in Part Three of the same Annex.
What goes on the machine, in the box and on the listing
- The CE marking, visible, legible and indelible, on the machine; under the Regulation, on the packaging and accompanying documents only where the machine’s nature does not allow it, and always before the machine is placed on the market (Art. 24(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 24, paragraph 1Click opens the article on EUR-Lex., Art. 24(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 24, paragraph 2Click opens the article on EUR-Lex.). Under the Directive the letters are at least 5 mm high, a minimum that can be waived for small-scale machinery, and sit next to the manufacturer’s name, applied the same way (Art. 16Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 16Click opens the article on EUR-Lex., Annex III). How the mark is drawn across all product laws is CE marking.
- The noise label on outdoor equipment. Directive 2000/14/EC covers the outdoor equipment it lists, among them lawnmowers, lawn trimmers, grass trimmers, hedge trimmers, leaf blowers and portable chainsaws. “The CE marking shall be accompanied by the indication of the guaranteed sound power level”, on each item, visible, legible and indelible. The equipment in its Article 12, lawnmowers and lawn trimmers among it, must also stay under the noise limits set there; the equipment in its Article 13 is marked only (Directive 2000/14/EC, Art. 2(1), 4(1), 11(2), 11(3), 12, 13).
- The machine’s identity: its designation, series or type, serial number where there is one, and the year of construction, the year the manufacturing process was completed (Annex I, section 1.7.3, of the Directive; Art. 10(5)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 5Click opens the article on EUR-Lex.).
- Who made it: the manufacturer’s name and address, and under the Regulation a website, email or other digital contact (Art. 10(6)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 6Click opens the article on EUR-Lex.). An importer adds the same about itself (Art. 13(3)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 13, paragraph 3Click opens the article on EUR-Lex.).
- The instructions. Under the Directive, with the machine, marked “Original instructions” or “Translation of the original instructions”, in the official language or languages of the EU country where it is placed on the market or put into service. A translation “must be accompanied by the original instructions” (Annex I, sections 1.7.4 and 1.7.4.1). Under the Regulation they may be digital, on the conditions in Art. 10(7)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 7Click opens the article on EUR-Lex.; their content list is Annex III, section 1.7.4.2. What either kind must contain for consumers is in EU user manual requirements.
- The declaration of conformity. Under the Directive the EC declaration accompanies the machine (Art. 5(1)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 5, paragraph 1Click opens the article on EUR-Lex., point (e)). Under the Regulation the EU declaration accompanies it, or the instructions give the web address or machine-readable code where it can be read, kept online for the lifetime and at least 10 years (Art. 10(8)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 10, paragraph 8Click opens the article on EUR-Lex.). Where several EU laws requiring a declaration apply, one declaration covers them all (Art. 21(3)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 21, paragraph 3Click opens the article on EUR-Lex.).
- For partly completed machinery: the declaration of incorporation and the assembly instructions, instead of a declaration of conformity and a CE marking. The declaration states which essential requirements are applied and fulfilled, and that the product must not be put into service until the final machine has been declared in conformity (Art. 13Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 13Click opens the article on EUR-Lex., Annex II, part 1, section B; Art. 11(7)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 11, paragraph 7Click opens the article on EUR-Lex., Art. 11(8)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 11, paragraph 8Click opens the article on EUR-Lex., Art. 22Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 22Click opens the article on EUR-Lex., Annex V, Part B).
On the listing itself, GPSR’s distance-sales rule applies to machinery that consumers may use, since GPSR covers only products meant for consumers or likely to be used by them (Art. 3(1)Regulation (EU) 2023/988, General Product Safety RegulationArticle 3, point 1Click opens the article on EUR-Lex.). A machine made for professionals and not likely to reach consumers is outside it. The rule asks for the manufacturer’s name and postal and electronic address, the EU responsible person where the manufacturer is outside the EU, information identifying the product with a picture and its type, and the warnings and safety information, in a language consumers easily understand as the country of sale determines (Art. 19Regulation (EU) 2023/988, General Product Safety RegulationArticle 19Click opens the article on EUR-Lex., Art. 2(1)Regulation (EU) 2023/988, General Product Safety RegulationArticle 2, paragraph 1Click opens the article on EUR-Lex.). The Blue Guide, section 4.5.1.4, adds that “it is useful that the CE marking and any required warnings according to applicable legislation are indicated in that website and are visible before the end user is carrying out the purchase.”
What happens if you sell without it
Where an authority finds the CE marking missing or wrongly affixed, the notified body number missing or wrong, the declaration missing or wrong, the technical documentation unavailable or incomplete, or the manufacturer’s or importer’s details absent, false or incomplete, it requires the business to put it right. If that persists, it restricts or prohibits the machine, or has it recalled or withdrawn (Art. 46Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 46Click opens the article on EUR-Lex.). The same applies to a missing declaration of incorporation for partly completed machinery (Art. 46(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 46, paragraph 2Click opens the article on EUR-Lex.).
Where a machine presents a risk and does not comply, the authority orders corrective action within a period it sets. If the business does not act, the authority has the machine withdrawn or recalled, or its sale prohibited or restricted, and tells the other EU countries (Art. 43(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 43, paragraph 1Click opens the article on EUR-Lex., Art. 43(4)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 43, paragraph 4Click opens the article on EUR-Lex.). This procedure has applied to machinery under the Directive since 19 July 2023 (Art. 52(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 52, paragraph 1Click opens the article on EUR-Lex.).
Each EU country sets the penalties. They must be effective, proportionate and dissuasive, and under the Regulation they may include criminal penalties for serious infringements (Art. 50(1)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 50, paragraph 1Click opens the article on EUR-Lex.; Art. 23Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 23Click opens the article on EUR-Lex.). Under the Directive, a machine without the CE marking or without the declaration is itself a non-conformity of marking (Art. 17(1)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 17, paragraph 1Click opens the article on EUR-Lex., point (b)).
What the law leaves open
- Harmonised standards under the Regulation. The list of harmonised standards under the Directive is repealed from 20 January 2027 (Implementing Decision (EU) 2026/2015, Art. 2). No Commission decision publishing harmonised standards under Regulation (EU) 2023/1230Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)The whole regulationClick opens the law on the EU Publications Office. appears in the Publications Office’s records as of 5 October 2026. That matters most for Annex I, Part B machines such as portable chainsaws: without category-specific harmonised standards or common specifications, the Regulation allows no self-assessment for them (Art. 25(3)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 25, paragraph 3Click opens the article on EUR-Lex.). The Commission may adopt common specifications where standards are missing (Art. 20(3)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 20, paragraph 3Click opens the article on EUR-Lex.).
- AI in machines. The Commission must add health and safety requirements for high-risk AI systems to Annex III by delegated acts that apply by (Art. 8Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 8Click opens the article on EUR-Lex., third and fourth paragraphs, inserted by Regulation (EU) 2026/1744Regulation (EU) 2026/1744, Digital Omnibus on AIThe whole regulationClick opens the law on the EU Publications Office.).
- Directive certificates after 2027. EC type-examination certificates issued under the Directive “shall remain valid until they expire” (Art. 52(2)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 52, paragraph 2Click opens the article on EUR-Lex.). The Regulation does not say whether such a certificate counts as the conformity assessment for a unit placed from 20 January 2027, which must meet Annex III of the Regulation and go through a procedure of Art. 25Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 25Click opens the article on EUR-Lex.. Where the Regulation’s requirements go beyond the Directive’s, such as protection against corruption of safety software (Annex III, section 1.1.9), a Directive certificate was issued against requirements that do not include them.
- Own-brand sellers under the Directive. The Directive’s definition of manufacturer names whoever designs and/or manufactures the machine (Art. 2(i)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 2, point (i)Click opens the article on EUR-Lex.); the Regulation adds whoever has it designed or made (Art. 3(18)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 18Click opens the article on EUR-Lex.). The Commission’s guide reads the Directive the same way, but that reading is guidance, not law.
- Stock and fulfilment centres. The law counts a unit as placed at its first making available (Art. 3(12)Regulation (EU) 2023/1230, Machinery Regulation (consolidated text of 27 July 2026)Article 3, point 12Click opens the article on EUR-Lex.). That own stock is not yet placed, and that stock released into an EU fulfilment centre is, comes from the Blue Guide, sections 2.3 and 2.4, which is Commission guidance.
- 3D printers before 2027. The Directive excludes ordinary office machinery covered by the low-voltage Directive and does not say whether a 3D printer is one (Art. 1(2)(k)Directive 2006/42/EC, Machinery Directive (consolidated text of 30 May 2026)Article 1, paragraph 2, point (k)Click opens the article on EUR-Lex.). The Regulation settles it from 20 January 2027.
