Spain battery registration for non-EU sellers (pilas)
A seller outside Spain that sells batteries, loose or built into a product, to buyers in Spain is the producer there (Real Decreto 106/2008 art. 3(o), 5(6); Regulation (EU) 2023/1542 Art. 3(47)(d)). It registers once, free of charge, in the battery section of the Registro Integrado Industrial, run by the Ministry of Industry and Tourism (RII-PYA), and shows the registration number on its website and its invoices. The ministry validates the application only with a contract with an authorised collective scheme, or the communication of an individual system, and Article 56(3) of the Regulation requires a representative in Spain. Batteries from outside the EU are not released at the Spanish border without the registration (Real Decreto 993/2022 art. 4(4)). Not registering is a serious infringement of Ley 7/2022, fined EUR 2,001 to 100,000 (art. 108(3)(ac), 109(1)(b)); the law equates the RII-PYA with the register it names only for the transitional period of its additional provision 12, three years from 10 April 2022.
A seller outside Spain that sells batteries, loose or built into a product, to buyers in Spain is the producer there. It registers once, free of charge, in the battery section of the Registro Integrado Industrial, which the Ministry of Industry and Tourism runs, and puts the registration number on its website and its invoices. The ministry validates the application only when it comes with a contract with a collective scheme, or the communication of an individual system. This page lists only what Spain adds to the EU Battery Regulation, which says when you are the producer and what the rest of the Regulation requires. The other Spanish rules are on Selling in Spain as a non-EU company.
Older texts use other names. Real Decreto 993/2022 calls the ministry “de Industria, Comercio y Turismo” (art. 6(7)). The ministry’s page now reads “Industria y Turismo”, and its FAQ says the old register name REI-RPA is the same register as the RII-PYA (ministry FAQ).
Spain adds a scheme, a ministry form and a border check to the EU registration
The EU rule makes a seller that ships to end-users in a country where it is not established the producer there, and has it appoint an authorised representative for extended producer responsibility in that country by written mandate (Regulation 2023/1542, Art. 3(47)(d) and Art. 56(3)). Spain’s Real Decreto 106/2008 already made the producer anyone who first places batteries on the market professionally, distance communication included (art. 3(o), (q)). Its article 5(6), last amended by Real Decreto 27/2021 and in force from , names the seller located in another country: it must tell the register it is a producer and obtain the registration number (art. 5(6)). The ministry says the same in plain words: a distance seller established outside Spain that sells to households or professional users in Spain is a producer (ministry FAQ).
What Spain sets on top:
- one registration and one number for the producer, in the Ministry of Industry’s own register, free of charge (disposición adicional primera, annex IV, ministry FAQ);
- proof of an EPR scheme before the application is validated (application form);
- the registration number on your website and on the invoice to the buyer (disposición adicional primera, 2);
- a quarterly declaration in the register (ministry);
- a check of the registration at the border for batteries from outside the EU (Real Decreto 993/2022 art. 4(4)).
Do this, in this order
- Sort each battery into the form’s categories. The application asks for the category and the product of each battery you place on the market (user manual). The form’s list has seven entries: portable non-rechargeable, portable rechargeable, batteries up to 25 kg for light means of transport, batteries for starting, ignition or lighting, industrial non-rechargeable, industrial rechargeable, and batteries for the traction of electric or hybrid vehicles (application form). They follow the Regulation’s five categories, portable, industrial, LMT, electric vehicle and SLI (Art. 55(3)(c)), with portable and industrial each split by rechargeability. The Decree’s own list of eight types (button cells, standard cells, portable accumulators, automotive batteries, industrial batteries with cadmium, with lead, with neither, and other types) is older (art. 5(1)); the annual declaration still breaks the amounts down at least by those types (disposición adicional primera, 3).
- Set up your EPR system first. The Decree names four ways: join a collective system, run an individual system, set up a deposit and return system, or pay into the public systems (art. 5(2)). The notice on the ministry’s form names two: a contract with an authorised collective scheme, or, for an individual system, the communication made to the environment department of the autonomous community where the producer has its seat. Without one of the two, “no será validada” (application form). The collective schemes are in the next section.
- Name your representative in Spain. The Regulation requires it; the register’s form leaves it optional. The table in “The representative: four texts, four answers” below sets out the four texts. The EU side of the role is in EPR authorised representative.
- Apply in the RII-PYA. Sign in with Cl@ve and fill in the tabs: the applicant; the producer (document type and number, name, company name, country, address, e-mail, telephone, website, sales technique: distance, direct or both); the scheme contract; the products; and the people (application form, user manual). The document types are NIF, NIE, VAT, passport and other. Documents upload as PDF files of up to 10 MB each. Name at least one legal representative of the company and one data manager; the data manager becomes the producer’s administrator user once the application is approved (user manual). The ministry says some schemes register their members for them (ministry FAQ), and Ecopilas says it enters the registration after the signed membership contract comes back (Ecopilas).
- Wait for the number before you ship. The ministry validates the data and then notifies the number (ministry). It states no time limit. The Regulation bars you from making batteries available in Spain until you or your representative are registered (Art. 55(2)) and says the authority grants the registration within 12 weeks of a complete application (Art. 55(9)(b)).
- Show the number. It goes on the invoice to the buyer and on the website or other tool that supports the sale (disposición adicional primera, 2).
- Declare and keep the data current. See the deadlines below.
Who can take your membership
Spanish collective schemes (SCRAP) are non-profit associations or entities. The autonomous community where a scheme has its seat authorises it, and the authorisation is valid for the whole country (art. 8(1), (2)). Its term is eight years, renewable (Ley 7/2022 art. 50(2)); the five years in the Decree (art. 8(2)) predate the law. Ley 7/2022 leaves the schemes that existed when it came into force under the rules of their waste stream until one year after the rules adapting that stream to the law take effect (second transitional provision), and the BOE lists no change to the Decree since 2021 (BOE analysis). On that rule a scheme authorised under the Decree keeps its five years, and one authorised under the law has eight. No page read says which term a given scheme holds. A scheme covers its net costs from its members’ contributions (art. 8(5)) and, where article 5(4) applies, provides the financial guarantee for its members itself (art. 8(6)). An individual system carries its own guarantee where article 5(4) applies (art. 7(3)). The Regulation lets a producer appoint an authorised producer responsibility organisation and lets an EU country make that compulsory (Art. 57(1)); the Decree names the scheme as one of the ways, and the ministry’s form makes a scheme or an individual-system communication a condition of the application.
| Scheme | What it says about itself |
|---|---|
| Fundación Ecopilas, administered by Recyclia | A foundation for the management and recycling of batteries; a producer fills in a membership form, receives a personalised contract, and is then registered in the RII-PYA (Ecopilas and Recyclia) |
| ERP | Offers compliance with the local rules on waste electrical equipment and on batteries and accumulators (ERP) |
The two rows come from the schemes’ own pages. The battery tab of the ministry’s application form offers six schemes to attach a contract to: AMBIPILAS, Asociación Ecolec para la Gestión de Residuos de Pilas y Acumuladores, Asociación Sun Re-Battery, Ecopilas, ERP España and Unibat, S.L. (application form). No page read calls that drop-down a list of authorised schemes, and the pages read give no tariff for a seller from abroad.
The representative: four texts, four answers
| Text | What it says about a seller outside Spain |
|---|---|
| Regulation 2023/1542, Art. 56(3) | A distance seller appoints an authorised representative for EPR in each country where it sells batteries, by written mandate. |
| Real Decreto 993/2022 art. 5(3) | An importer of batteries not established in Spain must name an authorised representative (last sentence). The paragraph opens with importers established in Spain, “including those who make distance sales from other countries”, and the decree does not say whether a seller outside the EU that ships to a consumer in Spain is the importer meant. The rule covers goods imported from third countries (art. 2(1)). |
| RII-PYA user manual | If the country entered is not Spain, the applicant may add an authorised representative who lives in Spain, with a document proving the agreement. |
| Ley 7/2022 art. 40 | A producer from abroad must meet the producer duties and may designate a person in Spain. The requirements for a representative are left to each waste stream. |
The Regulation is directly applicable and requires the representative; the register’s form lets you leave it out. Real Decreto 106/2008 mentions an authorised representative only once, in the sentence that sends import checks to the designated authorities (art. 5(6)), and defines no role and no qualification. No text read says what the ministry does with an application that has no representative.
What it costs
| Item | Amount | Basis |
|---|---|---|
| Registration in the RII-PYA | No fee | Ministry FAQ; the Decree allows a fee only if proportionate and cost-based (annex IV, 3) |
| Scheme contribution | Set by each scheme from its members’ contributions; no official tariff | Art. 8(5); Ecopilas invoices at the end of each quarter on its approved tariffs (Ecopilas) |
| Financial guarantee | Where article 5(4) applies, the scheme provides it for its members and an individual system carries its own | Art. 5(4), art. 8(6); the form’s guarantee fields are optional unless the application includes a cadmium product (user manual) |
| Representative in Spain | Set by the representative; no official figure |
Deadlines
| What | When |
|---|---|
| Registration | Before you make a battery available in Spain (Regulation Art. 55(2)). The authority grants it within 12 weeks of a complete application (Art. 55(9)(b)); the ministry gives no time of its own. |
| Declaration of what you placed on the market | Every quarter, in the register (ministry); Ecopilas lists the same quarterly duty (Ecopilas). The ministry’s pages give no day on which a quarter falls due. |
| Correcting an earlier quarter | Up to 25 January of the following year (ministry FAQ) |
| Data on the previous calendar year | Added to the register each year, by type, origin and use (disposición adicional primera, 3) |
| Annual report of the producer or its EPR system | To the autonomous communities, before 1 April (art. 18(1)) |
| Change in your registration data | Within one month (annex IV, 4) |
| You stop being a producer in Spain | You deregister and tell the register (annex IV, 5) |
For batteries imported from outside the EU, MITECO treats the day of the customs declaration for release as the day of placing on the market, so the quarterly declaration has to match the customs declaration (MITECO note). The note is undated and was written before Real Decreto 993/2022 took effect.
Batteries from outside the EU need the number at the border
Real Decreto 993/2022 applies to imports from third countries of every kind of battery, accumulator and battery pack (art. 2(1)(b)). Release for free circulation is prohibited when the importer has not met the register duties (art. 4(4)). A missing registration number is a curable non-conformity: the goods are not released until the importer proves it has one and the inspector checks it (art. 9(3)). The SOIVRE service of the Direcciones Territoriales y Provinciales de Comercio does the check, on a notification the importer or its customs representative files before release (arts. 4, 6, 10). Article 2(4) exempts goods without commercial character and names no value limit.
Marketplaces
A platform takes on, as producer, the financial, information and organisational duties of a producer in another EU state or a third country that sells through it and is not registered in the EPR registers or meeting the EPR duties. The platform may make a single registration for all the products concerned and must keep a record of them (Ley 7/2022 art. 2(ac)). The ministry publishes a public search of registered producers, and the Regulation gives online platforms free access to the register where it is not public (Art. 55(13)). What a platform asks you for under the EU rule is in the EU guide.
If you do nothing
You may not make batteries available in Spain (Regulation Art. 55(2)), and batteries from outside the EU are not released at the border (Real Decreto 993/2022 art. 4(4)). The Regulation leaves the penalties to each country (Art. 93). Spain’s apply through two laws, because Real Decreto 106/2008 sends infringements to the regime of Ley 22/2011, which Ley 7/2022 repealed, and to Ley 21/1992 de Industria (art. 22(1), Ley 7/2022, first repealing provision).
| Breach | Up to |
|---|---|
| Not registering in the producer register, not giving the registration number where it must appear, or not sending the product information: a serious infringement (Ley 7/2022 art. 108(3)(ac)). The law equates the RII-PYA with that register only during the transitional period of additional provision 12; whether (ac) reaches the RII-PYA after it is not settled | EUR 100,000 (EUR 2,001 minimum); up to twice the benefit obtained (art. 109) |
| Selling products without meeting the financial or organisational EPR duties: serious (art. 108(3)(p)) | The same band; the goods can be seized (art. 109(3)) |
| The same sale, where it gravely disturbs public health, the environment or consumer safety: very serious (art. 108(2)(ñ)) | EUR 3,500,000 (EUR 100,001 minimum, EUR 600,001 for hazardous waste) (art. 109(1)(a)) |
| Carrying on an activity without a mandatory registry entry: serious (Ley 21/1992 art. 31(2)(c)) | EUR 6,000,000 (art. 34(1)(b)) |
The Decree treats as hazardous the waste of lead, nickel-cadmium and mercury batteries, any waste battery with an asterisk in the European waste list, and the national codes of annex V, which cover lithium, nickel and other hazardous batteries (art. 3(j), annex V). The Ministry for the Ecological Transition has the power to sanction the registration and information duties of the Registro de Productores de Productos, and whether that reaches the RII-PYA after the transitional period of additional provision 12 is not settled. The Council of Ministers sanctions very serious infringements, and the autonomous communities sanction the EPR systems (Ley 7/2022 arts. 12, 111). Under Ley 21/1992 the Council of Ministers sanctions very serious infringements and the competent minister serious ones (art. 38).
What the texts leave open
These are the edges where Spanish law does not give one answer.
- The Decree and the Regulation. Real Decreto 106/2008 transposes Directive 2006/66/ECDirective 2006/66/EC, Batteries Directive (repealed by Regulation (EU) 2023/1542)The whole regulationClick opens the law on the EU Publications Office. (disposición final segunda). The Directive was repealed with effect from , except for a few provisions that run on for a time, among them its Article 11Directive 2006/66/EC, Batteries Directive (repealed by Regulation (EU) 2023/1542)The whole regulationClick opens the law on the EU Publications Office., which applies until , and the Regulation’s chapter on the management of waste batteries, which holds the producer duties, applies from (Art. 95, 96(2)). The BOE lists no later amendment or repeal of the Decree (BOE analysis), and MITECO’s battery page still names the Directive and the Decree and calls the Regulation a proposal (MITECO). No Spanish text read says which articles of the Decree the Regulation displaces.
- The register’s move. Ley 7/2022 additional provision 12 says the battery section of the Registro Integrado Industrial passes to the Registro de Productores de Producto within three years of , and that until then the law’s references to the latter also mean the former. The three years ended on 10 April 2025. MITECO’s register has four sections and none for batteries, and the Ministry of Industry’s form was open on 5 October 2026. No official page says whether the transitional wording of the law still holds.
- Which penalty law is used. Article 22(1) of the Decree names Ley 21/1992 and a repealed law, and Ley 7/2022 types the registration breach in terms of the Registro de Productores de Producto. No official page says which law is applied to a producer that is not registered in the battery register, or whether a registration breach counts as concerning hazardous waste.
- Who signs in, and from which community. The form needs Cl@ve, and the ministry names an electronic signature as the other means (ministry FAQ). The pages read do not say how a business outside Spain obtains either. An individual system is communicated to the community where the producer has its seat, and the pages read do not say which community receives it from a producer with no seat in Spain.
- Marketplaces and batteries. The platform clause of Ley 7/2022 art. 2(ac) is general to EPR products. The Spain page records that for packaging a platform stopped being the fallback producer on 12 August 2026. No text read withdraws the clause for batteries.
- A different register. Real Decreto 764/2026, in force from , regulates the Registro de producción y gestión de residuos. It does not mention the battery register. Its article 6(2)(f) sets the data held for the prior communications of individual EPR systems and the authorisations of collective systems under articles 49 and 50 of Ley 7/2022 (art. 6), which is where the individual-system communication that the RII-PYA form asks for is entered (Real Decreto 106/2008 art. 7(1)).
What does not apply
- No volume threshold and no registration fee: every producer registers, free of charge (disposición adicional primera, 1, ministry FAQ).
- One registration for the producer, not one for each brand or category (annex IV, 1). Brands are an optional field of the application (user manual).
- The Decree binds every distributor, meaning anyone who supplies or sells batteries to an end user (art. 3(p)), to take back used portable batteries free of charge at the time of supply (art. 10(2)). It says nothing on deliveries to the buyer; Article 62(4) and (5) of the Regulation spells that out, in the EU guide.
- No Spanish rule says who qualifies as a representative for batteries: Ley 7/2022 art. 40 leaves it to each waste stream, and the Decree has none.
- Packaging is not registered here. It has its own section in MITECO’s Registro de Productores de Producto.
The facts for Spain, with their sources
| Fact | Value | Source | Checked |
|---|---|---|---|
| Registration authority | The Ministry of Industry and Tourism runs the national register of battery and accumulator producers, the RII-PYA, which is the special battery section of the Registro Integrado Industrial. Once the data are validated, its Subdirección General de Calidad y Seguridad Industrial gives the producer access to the system and notifies the registration number. A producer or importer applies by form, and a new collective scheme has its own registration form. | Ministerio de Industria y Turismo, Alta en el Registro Nacional de productores de pilas y acumuladores | |
| Register | Registro Integrado Industrial, special section for battery producers. Every producer of batteries, accumulators or batteries registers in it or is already registered (disposición adicional primera, 1). The register gives each producer a registration number (disposición adicional primera, 2). A producer registers once, keeps the number, and tells the register of any change within one month (annex IV, 1 and 4). | Real Decreto 106/2008, disposición adicional primera and annex IV (boe.es, consolidated text updated 20 January 2021) | |
| Small-volume threshold | No volume threshold. All producers of batteries, accumulators or batteries must register (disposición adicional primera, 1). The scope of the Decree excludes only batteries in military equipment and in equipment sent into space (art. 2(2)); no exemption by volume appears in it or in the register rules. | Real Decreto 106/2008, art. 2 and disposición adicional primera (boe.es, consolidated text updated 20 January 2021) | |
| Registration fee | None. The ministry states that registration in the battery register is free of charge. The Decree allows a registration fee only if it is proportionate and based on costs (annex IV, 3). | Ministerio de Industria y Turismo, Registro de pilas y acumuladores: preguntas frecuentes | |
| How the fee is set | A collective scheme covers its net costs from fees or contributions paid by its member producers, and tells all members in good time of any expected change in waste-management costs (art. 8(5)). Each scheme sets its own contribution, and the pages read publish no official tariff. | Real Decreto 106/2008, art. 8(5) (boe.es, consolidated text updated 20 January 2021) | |
| How the fee is set | Ecopilas, a collective scheme, says that a member declares each quarter the products it placed on the market, and that the scheme invoices it at the end of the quarter on the tariffs approved for each type of product. | Ecopilas, Cómo adherirse (scheme page, not a government source) | |
| Filing deadline and frequency | The register carries a quarterly declaration of the batteries and accumulators a producer places on the market. The ministry's pages give no day on which a quarter's declaration falls due. | Ministerio de Industria y Turismo, Registro nacional de productores de pilas y acumuladores | |
| Filing deadline and frequency | A producer can correct data it declared for an earlier quarter up to 25 January of the year after the one being corrected. | Ministerio de Industria y Turismo, Registro de pilas y acumuladores: preguntas frecuentes | |
| Filing deadline and frequency | Each year the producer adds to the register the quantities placed on the market in the previous calendar year, by type, origin and use, with the autonomous communities where they were sold, the sales technique and brands, and the scheme used (disposición adicional primera, 3). Producers or their EPR systems send an annual report on their activities to the autonomous communities before 1 April (art. 18(1)). A change in the registration data is reported within one month, and a producer that stops being a producer in Spain deregisters (annex IV, 4 and 5). | Real Decreto 106/2008, art. 18(1), disposición adicional primera and annex IV (boe.es, consolidated text updated 20 January 2021) | |
| Penalty | Not registering in the producer register, not giving the registration number where it must appear, and not sending the product information are serious infringements (art. 108(3)(ac)). The law equates the RII-PYA with that register only during the transitional period of additional provision 12, three years from 10 April 2022, and whether (ac) reaches the RII-PYA after it is not settled. Selling products without meeting the financial or organisational EPR duties is serious too (art. 108(3)(p)). A serious infringement is fined EUR 2,001 to 100,000 (art. 109(1)(b)); the law sets a higher band, EUR 20,001 to 600,000, where hazardous waste or contaminated soil is concerned, and no text read applies it to a registration breach. A very serious one, where the breach gravely disturbs public health, the environment or consumer safety (art. 108(2)(ñ)), is fined EUR 100,001 to 3,500,000, or EUR 600,001 to 3,500,000 for hazardous waste (art. 109(1)). A fine below the benefit obtained can be raised to twice the benefit (art. 109(2)). | Ley 7/2022 de residuos y suelos contaminados, arts. 108 and 109 (boe.es, consolidated text updated 2 April 2025) | |
| Penalty | Real Decreto 106/2008 art. 22(1) sends infringements to the sanction regimes of Ley 22/2011, which Ley 7/2022 repealed, and of Ley 21/1992 de Industria. Under Ley 21/1992, carrying on an activity without a mandatory registry entry is a serious infringement (art. 31(2)(c)), fined up to EUR 6,000,000 (art. 34(1)(b)). Where an act is typified in several laws, it is classified under the one with the highest sanction (art. 34(5)). | Ley 21/1992 de Industria, arts. 31, 34 (boe.es, consolidated text updated 8 December 2018) | |
| Enforcement body | The Ministry for the Ecological Transition (MITECO) exercises surveillance, inspection and the power to sanction for the registration and information duties of the Registro de Productores de Productos (art. 12(3)(g)). Whether that power reaches the RII-PYA after the three years of additional provision 12 is not settled. Where the State sanctions, the Director General of Environmental Quality and Assessment fines minor infringements, the minister serious ones and the Council of Ministers very serious ones (art. 111(2)). The autonomous communities supervise and sanction the EPR systems (art. 12(4)(e)). | Ley 7/2022 de residuos y suelos contaminados, arts. 12 and 111 (boe.es, consolidated text updated 2 April 2025) | |
| Enforcement body | At the border, the SOIVRE inspection service of the Direcciones Territoriales y Provinciales de Comercio checks that the importer of batteries has met its register duties before release for free circulation (art. 4(2), 4(4), 10(2)). | Real Decreto 993/2022, arts. 4 and 10 (boe.es, in force from 16 January 2023) | |
| Language of filing | Spanish. The application form, its user manual and the ministry's battery pages are in Spanish, and no English version was found. Documents are uploaded as PDF files of up to 10 MB each. The applicant signs in with Cl@ve. | Ministerio de Industria y Turismo, RII-PYA: Alta de productor (application form) | |
| Local representative | Yes, under the EU rule. A seller established outside Spain that sells batteries by distance contract directly to end-users in Spain appoints an authorised representative for extended producer responsibility in Spain, by written mandate. | Regulation (EU) 2023/1542, consolidated text of 13 August 2026: Articles 3(47)(d) and 56(3) | |
| Local representative | Yes, for an importer. The last sentence of art. 5(3) says an importer that is not established in Spain must name an authorised representative, who is responsible for the registration duty. The rule covers goods imported from third countries, and release for free circulation is prohibited until the registration duties are met. The first sentence of art. 5(3) speaks of importers established in Spain, "including those who make distance sales from other countries". The decree does not say whether a seller outside the EU that ships to a consumer in Spain is the importer meant. | Real Decreto 993/2022, arts. 2(1), 4(4), 5(3) (boe.es, in force from 16 January 2023) | |

If the country entered is not Spain, the applicant may add the details of an authorised representative who lives in Spain, with a document proving the agreement. | Ministerio de Industria y Turismo, RII-PYA user manual: Solicitud inscripción productor | |
| Local representative | Ley 7/2022 says a producer established in another EU state or a third country that sells in Spain must meet the producer duties and may designate a person in Spain as authorised representative. It leaves the requirements for a representative to the rules of each waste stream, and Real Decreto 106/2008 sets none. | Ley 7/2022 de residuos y suelos contaminados, art. 40 (boe.es, consolidated text updated 2 April 2025) | |
| Marketplace can file for you | A platform takes on, as producer, the financial, information and organisational duties of a producer in another EU state or a third country that sells through it and is not registered in the EPR registers or meeting the EPR duties. The platform may make a single registration for all the products concerned and must keep a record of them. | National rule | The producer is anyone who first places batteries on the market professionally, whatever the selling technique, distance communication included. Placing on the market is supplying or making available in Spanish territory batteries made in Spain, bought in another EU country or imported from outside the EU (art. 3(o), (q)). A producer announces itself to the register, and a seller in another country must also obtain the registration number (art. 5(6), in force from 21 January 2021). | Real Decreto 106/2008, arts. 3(o), 3(q) and 5(6) (boe.es, consolidated text updated 20 January 2021) | |
| National rule | The ministry lists who is a producer: a manufacturer in Spain, a seller of own-label or distributor-brand batteries, an importer, a distributor that imports, and a distance seller established outside Spain that sells directly to households or professional users in Spain. All of them register and declare. Some collective schemes register their members in the register for them. | Ministerio de Industria y Turismo, Registro de pilas y acumuladores: preguntas frecuentes | |
| National rule | The application is not validated unless the producer has first set up an EPR system and attaches either a contract with an authorised collective scheme or the communication of an individual system, made to the environment department of the autonomous community where the producer has its seat (annex XII of Ley 7/2022). The form asks for the guarantee type, the sales technique (distance, direct or both) and the scheme contract. | Ministerio de Industria y Turismo, RII-PYA: Alta de productor (application form) | |
| National rule | For goods imported from outside the EU, the border inspection service checks the importer's registration in the Registro Integrado Industrial before release. Release is prohibited if the importer has not met the register duties (art. 4(4)). A missing registration number is a curable non-conformity: the goods are not released until the importer proves it has one and an inspector checks it (art. 9(3)). Goods without commercial character are exempt (art. 2(4)). | Real Decreto 993/2022, arts. 2, 4, 9 (boe.es, in force from 16 January 2023) | |
| National rule | Ley 7/2022 additional provision 12 says that within three years of its entry into force the electrical-equipment and battery sections of the Registro Integrado Industrial are to become sections of the Registro de Productores de Producto, and that until then the law's references to the latter also mean the former. The law came into force on 10 April 2022, so the three years ended on 10 April 2025. The battery register is still run by the Ministry of Industry, and its application form was open on 5 October 2026. | Ley 7/2022 de residuos y suelos contaminados, disposición adicional duodécima (boe.es, consolidated text updated 2 April 2025) | |
