Construction Products Regulation (EU) 2024/3110: what applies to you now and what waits
You sell tiles, windows, insulation, fixings, cables or another product built into a building, and the new law has changed the paperwork.
A product with a standard cited under the 2011 Regulation still follows it: the manufacturer issues a declaration of performance and affixes CE marking. The 2024 Regulation takes over family by family, and the duties of sellers, online sellers included, wait until then.
Regulation (EU) 2024/3110, the new Construction Products Regulation, entered into force on 7 January 2025 and applies from 8 January 2026, apart from the articles that apply earlier or later (Art. 96Regulation (EU) 2023/988, General Product Safety RegulationArticle 96Click opens the article on EUR-Lex.). It repeals Regulation (EU) No 305/2011 from 8 January 2026, except for the articles on the declaration of performance, CE marking, economic operators, harmonised standards and notified bodies, which stay until 8 January 2040 for products covered by a standard cited under the old Regulation or by a European assessment document cited under it (Art. 94Regulation (EU) 2023/988, General Product Safety RegulationArticle 94Click opens the article on EUR-Lex., Art. 95(3)Regulation (EU) 2023/988, General Product Safety RegulationArticle 95, paragraph 3Click opens the article on EUR-Lex., Art. 95(4)Regulation (EU) 2023/988, General Product Safety RegulationArticle 95, paragraph 4Click opens the article on EUR-Lex., Art. 95(8)Regulation (EU) 2023/988, General Product Safety RegulationArticle 95, paragraph 8Click opens the article on EUR-Lex.). The duties of economic operators in Chapters I to III of the new Regulation, among them the declaration of performance and conformity, CE marking and the online-sale rules, apply to a product family, or a product category within it, only from one year after the Commission adopts the implementing act that makes that family's new performance harmonised standard mandatory, unless the act names a later date (Art. 95(9)Regulation (EU) 2023/988, General Product Safety RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex., Art. 5(8)Regulation (EU) 2023/988, General Product Safety RegulationArticle 5, paragraph 8Click opens the article on EUR-Lex.). The Commission's page on harmonised standards says the first such acts, for cement, are probably due in 2027; its working plan puts the adoption for cement in the fourth quarter of 2027, so the cement duties would start around the fourth quarter of 2028. Until the switch, a manufacturer of a product covered by a standard cited under the old Regulation draws up a declaration of performance, affixes the CE marking and keeps the documentation for 10 years; an importer or distributor checks them before selling (Regulation (EU) No 305/2011, Art. 4(1)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 4, paragraph 1Click opens the article on EUR-Lex., 8(2), 9, 11, 13, 14). After the switch the declaration becomes a declaration of performance and conformity in the model of Annex V, supplied electronically, with environmental performance on a life cycle basis; the CE marking is followed by more details; a manufacturer outside the EU must appoint a single authorised representative; and an online offer must show the CE marking, the details after it and any label (Art. 13Regulation (EU) 2023/988, General Product Safety RegulationArticle 13Click opens the article on EUR-Lex., 15, 16, 18(2), 23(1), 29(2)). The text does not settle whether the duties of an online marketplace (Art. 28Regulation (EU) 2023/988, General Product Safety RegulationArticle 28Click opens the article on EUR-Lex.), which must give operators the means to do that, name a single contact point for authorities and cooperate on removal orders, wait for the switch too: Art. 95(9)Regulation (EU) 2023/988, General Product Safety RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex. defers the obligations of economic operators, and a marketplace is not named among them in Art. 3Regulation (EU) 2023/988, General Product Safety RegulationArticle 3Click opens the article on EUR-Lex., point (9), but Art. 28(2)Regulation (EU) 2023/988, General Product Safety RegulationArticle 28, paragraph 2Click opens the article on EUR-Lex. is a duty of each EU country towards all products covered by the Regulation. Regulation (EU) 2019/1020 already requires an operator established in the EU for products under the old Regulation, and a distance offer aimed at EU customers counts as made available on the EU market (Art. 4(1)Regulation (EU) 2023/988, General Product Safety RegulationArticle 4, paragraph 1Click opens the article on EUR-Lex., 4(5), 6). The duty of each EU country to lay down penalties applies from 8 January 2027, and the countries notify them by 8 December 2026 (Art. 92Regulation (EU) 2023/988, General Product Safety RegulationArticle 92Click opens the article on EUR-Lex., Art. 96Regulation (EU) 2023/988, General Product Safety RegulationArticle 96Click opens the article on EUR-Lex.). The duties of Chapter III apply only to products covered by a harmonised technical specification or CE-marked on a European technical assessment (Art. 20(1)Regulation (EU) 2023/988, General Product Safety RegulationArticle 20, paragraph 1Click opens the article on EUR-Lex.).

For a seller the stage that counts is the switch of a product family, or of a category within it. The new duties start one year after the Commission adopts the implementing act that makes that family’s new standard mandatory, or on a later date the act names (Art. 95(9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex., Art. 5(8)Regulation (EU) 2024/3110, Construction Products RegulationArticle 5, paragraph 8Click opens the article on EUR-Lex.). The Commission says the first such acts, for cement, are probably due in 2027 (European Commission, harmonised technical specifications). Its working plan puts the adoption for cement in the fourth quarter of 2027, so on that plan the cement duties would start around the fourth quarter of 2028 (Commission working plan, Table 3). Until the switch, a product that a standard cited under the old Regulation covers keeps the old rules: the manufacturer draws up a declaration of performance and affixes the CE marking.
What you do:
- Settle whether the Regulation reaches your product. It does only if the product is a construction product, meaning an item placed on the market to be built permanently into a building or civil engineering work, and a harmonised standard cited under the old Regulation covers it or a European technical assessment has been issued for it (Art. 3, points (1) and (3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 3Click opens the article on EUR-Lex., Art. 20(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 20, paragraph 1Click opens the article on EUR-Lex., Art. 4(1)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 4, paragraph 1Click opens the article on EUR-Lex.; European Commission, CPR overview). Annex VII lists 36 product families, from cement and doors and windows to insulation, fixings, adhesives, sealants and cables. A product no such standard or assessment covers needs no declaration and takes no CE marking under this Regulation.
- If you make the product, you draw up the technical documentation and the declaration of performance, affix the CE marking, and keep both for 10 years (Art. 4(1)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 4, paragraph 1Click opens the article on EUR-Lex., Art. 6Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 6Click opens the article on EUR-Lex., Art. 8(2)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 8, paragraph 2Click opens the article on EUR-Lex., Art. 9Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 9Click opens the article on EUR-Lex., Art. 11(1)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 11, paragraph 1Click opens the article on EUR-Lex., Art. 11(2)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 11, paragraph 2Click opens the article on EUR-Lex.).
- If you import or distribute it, check before you sell that the product carries the CE marking, comes with the declaration of performance and has instructions and safety information in a language the country of sale determines and users can easily understand. An importer adds its own name and contact address (Art. 13(2)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 13, paragraph 2Click opens the article on EUR-Lex., Art. 13(3)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 13, paragraph 3Click opens the article on EUR-Lex., Art. 13(4)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 13, paragraph 4Click opens the article on EUR-Lex., Art. 14(2)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 14, paragraph 2Click opens the article on EUR-Lex.).
- If the manufacturer is outside the EU, name an operator established in the EU: an EU manufacturer, an importer, an authorised representative or, where none of these exists, a fulfilment service provider (Art. 4(1)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 1Click opens the article on EUR-Lex., Art. 4(2)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 2Click opens the article on EUR-Lex., Art. 4(5)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 5Click opens the article on EUR-Lex.). Who can play that part is in EU responsible person.
- Selling another maker’s product under your own name or trademark makes you the manufacturer, with every manufacturer duty (Art. 15Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 15Click opens the article on EUR-Lex.; Art. 26(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 26, paragraph 1Click opens the article on EUR-Lex.).
- Selling online counts as selling in the EU when the offer is aimed at EU customers (Art. 6Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 6Click opens the article on EUR-Lex.). The online-sale duties of the new Regulation for sellers wait for the switch, as set out below.
- Find the date of your product family. The implementing act for it sets the clock: the new rules apply one year after the Commission adopts it, or on a later date the act names, and you may apply them earlier if you choose (Art. 95(9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex.).
Two Regulations apply side by side, and each product family moves from the old to the new on its own date
The Commission calls this the coexistence principle: “Product families will migrate to the new framework individually. If a product is covered by a standard cited under the CPR-2011, in principle the provisions of the CPR-2011 apply. Once a new performance harmonised standard is cited under CPR-2024, the product family must follow the new regulation” (European Commission, CPR 2024 revision). The law says the same in its transitional article. Harmonised standards cited under the old Regulation stay valid under it until the Commission withdraws them. The old articles on the declaration of performance, CE marking and operators then apply only to products covered by those standards or by the old European assessment documents (Art. 95(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 3Click opens the article on EUR-Lex., Art. 95(8)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 8Click opens the article on EUR-Lex.).

The Commission’s page says the system “will be established soon” |
The plan of the Commission gives an idea of the order. Its working plan for 2026 to 2029 lists, for cement, building limes and other hydraulic binders, a planned date of the fourth quarter of 2027 for adopting the implementing act that makes the standards mandatory, and 2029 for doors, windows, shutters, gates and building hardware (Commission working plan, Table 3). The duties start one year after the act, so on that plan around the fourth quarter of 2028 for cement and in 2030 for doors and windows. It is a plan, and a family’s own date is the one the implementing act sets.

Every operator under the new Regulation must also, on request of an authority, name its suppliers and customers for a product, keep its documents for 10 years and present them within 10 days of a request, and give users a channel such as a telephone number or an email address to report an accident or a safety issue (Art. 20(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 20, paragraph 3Click opens the article on EUR-Lex., Art. 20(4)Regulation (EU) 2024/3110, Construction Products RegulationArticle 20, paragraph 4Click opens the article on EUR-Lex., Art. 20(5)Regulation (EU) 2024/3110, Construction Products RegulationArticle 20, paragraph 5Click opens the article on EUR-Lex.).
The declaration of performance and the declaration of conformity become one document, the DoPC
Under the old Regulation the manufacturer draws up a declaration of performance, the DoP. It states how the product performs on its essential characteristics, as the harmonised standard sets them (Art. 4(1)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 4, paragraph 1Click opens the article on EUR-Lex., Art. 6(1)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 6, paragraph 1Click opens the article on EUR-Lex.). The old Regulation has no declaration of conformity of its own. That term belongs to the Directive 89/106/EEC it replaced.
The new Regulation merges the two into the declaration of performance and conformity, the DoPC. It expresses the product’s performance on its essential characteristics and, where product requirements apply, states that the product meets them (Art. 15(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 15, paragraph 1Click opens the article on EUR-Lex.). By drawing it up the manufacturer takes responsibility for the product’s conformity with its declared performance and the requirements, and becomes liable under national law (Art. 13(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 13, paragraph 2Click opens the article on EUR-Lex.).

The environmental part is phased. The declaration must cover at least the climate-change characteristics of Annex II from 8 January 2026, the points (e) to (m), among them ozone depletion, acidification and water use, from 9 January 2030, and the points (n) to (s), among them particulate matter and land-use impacts, from 9 January 2032 (Art. 15(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 15, paragraph 3Click opens the article on EUR-Lex.). Read it with Art. 95(9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex.: the duties of Chapter II reach a product family only after its switch.
The DoPC is the declaration of this Regulation. Other EU product laws, such as the low-voltage and machinery rules, have an EU declaration of conformity of their own; how those declarations work is on the declaration of conformity.
A manufacturer of a product that no harmonised technical specification covers may still issue a DoPC, in line with a European assessment document and a European technical assessment (Art. 13(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 13, paragraph 1Click opens the article on EUR-Lex.). That is the voluntary route through a technical assessment body. The Commission says it gives such a product the same tools as a standard-covered one: CE marking with a data carrier, the DoPC, the product information and, once it exists, the passport (European Commission, voluntary CE marking).
Today, under the old Regulation, a manufacturer of a product covered by a harmonised standard may refrain from drawing up a declaration of performance in three cases, and only where no Union or national provision requires the declaration of essential characteristics where the product is to be used. The cases are a product made individually or to order in a non-series process and installed in a single identified construction work by a manufacturer responsible for its safe incorporation; a product made on the construction site for that work; and a product made in a traditional or heritage-conservation manner in a non-industrial process, to renovate officially protected works (Art. 5Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 5Click opens the article on EUR-Lex.).
After the switch, two exemptions let a manufacturer skip the declaration. The first covers a product that is individually manufactured or custom-made in a non-series process, made to a specific order, installed in a single identified construction work by a manufacturer who is also responsible for its safe incorporation, and compliant with national rules. The second covers a product made in a way suited only to the conservation of officially protected buildings, in a non-series process (Art. 14Regulation (EU) 2024/3110, Construction Products RegulationArticle 14Click opens the article on EUR-Lex.). Separately, a micro-enterprise may replace type-testing under assessment system 3 with a section in its technical documentation, and a manufacturer of a custom-made non-series product may replace the performance assessment in the same way (Art. 60Regulation (EU) 2024/3110, Construction Products RegulationArticle 60Click opens the article on EUR-Lex., Art. 61Regulation (EU) 2024/3110, Construction Products RegulationArticle 61Click opens the article on EUR-Lex.).
A certificate, a test report or a European technical assessment issued under the old Regulation may serve as the technical basis for the new declaration where the product type corresponds and the methods are still valid (Art. 95(7)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 7Click opens the article on EUR-Lex.). A declaration of performance drawn up under the old Regulation stays the right document for as long as the product’s family has not switched.
CE marking goes on only with a declaration behind it, and the new mark carries more after it
The CE marking is affixed only to products for which the manufacturer has drawn up the declaration (Art. 8(2)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 8, paragraph 2Click opens the article on EUR-Lex., Art. 17(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 17, paragraph 2Click opens the article on EUR-Lex.). A product that no cited standard and no assessment covers does not take it. The marking goes on visibly, legibly and indelibly, on the product, or on a label, the packaging or the accompanying documents where that is not possible, before the product is placed on the market (Art. 9Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 9Click opens the article on EUR-Lex., Art. 18Regulation (EU) 2024/3110, Construction Products RegulationArticle 18Click opens the article on EUR-Lex.). It is the only marking that attests the performance of the product on the characteristics assessed (Art. 8(3)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 8, paragraph 3Click opens the article on EUR-Lex., Art. 17(4)Regulation (EU) 2024/3110, Construction Products RegulationArticle 17, paragraph 4Click opens the article on EUR-Lex.). How the marking works across all EU product laws is in CE marking.
What follows the marking differs:
| After the CE marking | Old Regulation | New Regulation |
|---|---|---|
| Year | The last two digits of the year it was first affixed | The same; for a used product, the year of deinstallation and the year of marking |
| Manufacturer | Name and registered address, or an identifying mark | The same |
| Authorised representative | Not listed | Name and registered address, where the manufacturer is outside the EU or has chosen to appoint one |
| Product | The unique identification code of the product type, the level or class of performance declared, the harmonised specification applied, the intended use | The unique identification code of the product type |
| Declaration | The reference number of the declaration of performance | The declaration code |
| Notified body | Its identification number, if applicable | The number of the body or bodies that verified the product type and assessed factory production control, if applicable |
| Passport | Not listed | A data carrier linked to the digital product passport, once one exists |
The sources for the table are Art. 9(2)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 9, paragraph 2Click opens the article on EUR-Lex. and Art. 18(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 18, paragraph 2Click opens the article on EUR-Lex.. Under the new Regulation the unique code and the declaration code may be replaced by a data carrier, a permalink included, that leads to the declaration where it is on a website, and they may be left out where the passport’s data carrier is given (Art. 18(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 18, paragraph 2Click opens the article on EUR-Lex.). The marking may be followed by a pictogram or another mark that shows a special risk or use (Art. 18(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 18, paragraph 3Click opens the article on EUR-Lex.).
Other markings, private ones included, may go on the product only if they do not suggest that performance on the characteristics a harmonised specification covers had to be assessed in another way, and they must not impair the visibility, legibility and meaning of the CE marking. An officially recognised EN ISO 14024 type I ecolabel is allowed on the same conditions (Art. 19(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 19, paragraph 1Click opens the article on EUR-Lex., Art. 19(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 19, paragraph 2Click opens the article on EUR-Lex.). A performance claim on a characteristic a harmonised specification covers must follow its assessment method and, elsewhere than in the declaration, may be made only if the declaration already holds it (Art. 19(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 19, paragraph 3Click opens the article on EUR-Lex., Art. 19(4)Regulation (EU) 2024/3110, Construction Products RegulationArticle 19, paragraph 4Click opens the article on EUR-Lex.). The old Regulation says that for such a product the information may be given only if it is included in the declaration (Art. 4(2)Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)Article 4, paragraph 2Click opens the article on EUR-Lex.).
Harmonised technical specifications now mean the mandatory ones only
Under the old Regulation the term covers harmonised standards and European assessment documents. Under the new one it covers only the performance harmonised standards the Commission has made mandatory, the fall-back implementing acts used if standardisation is blocked, and three kinds of delegated act: those that set product requirements, those that set rules on product information and those that fix the assessment and verification system of a product family (Art. 3, point (42)Regulation (EU) 2024/3110, Construction Products RegulationArticle 3Click opens the article on EUR-Lex., Art. 6(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 6, paragraph 1Click opens the article on EUR-Lex., Art. 7(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 7, paragraph 1Click opens the article on EUR-Lex., Art. 9(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 9, paragraph 3Click opens the article on EUR-Lex., Art. 10(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 10, paragraph 2Click opens the article on EUR-Lex.; European Commission, harmonised technical specifications). European assessment documents are no longer part of it. They stay a route to voluntary CE marking. Delegated Regulation (EU) 2026/1310, which sets the assessment systems, is itself a delegated act of the last kind.
The path of a standard under the new Regulation has three steps. The Commission asks the European standardisation organisations to draft it; it assesses the result and, if the standard is in conformity, adopts an implementing act that makes it mandatory; the standard binds one year after that act, unless the act names a later date. It may be applied voluntarily from the day the act is adopted (Art. 5(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 5, paragraph 2Click opens the article on EUR-Lex., Art. 5(8)Regulation (EU) 2024/3110, Construction Products RegulationArticle 5, paragraph 8Click opens the article on EUR-Lex.). A standard cited under the old Regulation is replaced this way, and its citation is withdrawn after a transitional period of at least one year (European Commission, CPR 2024 revision).
The Regulation calls the area these specifications cover the harmonised zone. They are presumed to be comprehensive: they lay down all the essential characteristics and their assessment methods, specify all product requirements other than those under other EU law and fix the assessment systems. An EU country may not prohibit or impede a compliant product, may not lay down characteristics, tests or product requirements beyond them, and may not require a marking other than CE for what the zone covers. It keeps the right to set national requirements for how products are used (Art. 11(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 11, paragraph 1Click opens the article on EUR-Lex., Art. 11(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 11, paragraph 2Click opens the article on EUR-Lex., Art. 11(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 11, paragraph 3Click opens the article on EUR-Lex.). Where a country needs a measure on imperative grounds of health and safety or the environment for a characteristic the specifications do not lay down, it notifies the Commission, which can authorise it by implementing act (Art. 11(5)Regulation (EU) 2024/3110, Construction Products RegulationArticle 11, paragraph 5Click opens the article on EUR-Lex., Art. 11(6)Regulation (EU) 2024/3110, Construction Products RegulationArticle 11, paragraph 6Click opens the article on EUR-Lex.).
The Commission may also adopt delegated acts that set product requirements, for functional, safety or environmental aspects where a performance approach does not fit. A product subject to them must satisfy them before it is placed on the market (Art. 7(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 7, paragraph 1Click opens the article on EUR-Lex., Art. 7(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 7, paragraph 2Click opens the article on EUR-Lex.). Voluntary harmonised standards and common specifications can give a presumption of conformity with those requirements (Art. 7(7)Regulation (EU) 2024/3110, Construction Products RegulationArticle 7, paragraph 7Click opens the article on EUR-Lex., Art. 8(4)Regulation (EU) 2024/3110, Construction Products RegulationArticle 8, paragraph 4Click opens the article on EUR-Lex.).
A notified body takes part in some assessment systems and in none of others
The old Regulation’s systems carry over, with changes. The new Regulation has six assessment and verification systems: 1+, 1, 2+, 3+, 3 and 4. System 4 is the manufacturer’s self-verification and self-certification, with no task for a notified body. In the others a notified body issues a certificate or a validation report. Which system applies to a product family and category is set by Delegated Regulation (EU) 2026/1310 (Annex IX; Art. 10(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 10, paragraph 2Click opens the article on EUR-Lex.; Delegated Regulation (EU) 2026/1310, Art. 3). The delegated Regulation was published on and entered into force on the twentieth day after that, (Art. 4). It matters to you when a family switches. How a notified body works and how to find one is on notified body.
| System | What the notified body does | What the manufacturer does |
|---|---|---|
| 1+ | Decides on the certificate of constancy of performance and of conformity after confirming the product type, assessing performance, inspecting the plant and factory production control, keeping them under surveillance and testing audit samples before the product is placed on the market | Factory production control, further sample testing, the technical documentation |
| 1 | The same, without audit sample testing | The same |
| 2+ | Decides on the certificate of conformity of the factory production control after reviewing the product documentation, inspecting the plant and keeping the factory production control under continuing surveillance, with periodic inspections of the plant | Assesses performance, runs factory production control, tests samples, keeps the technical documentation |
| 3+ | Decides on the validation report for the environmental sustainability assessment: input values, assumptions, rules, software | Assesses the environmental performance and runs factory production control |
| 3 | Decides on the certificate of performance and conformity: confirms the product type and the performance, on testing by a notified laboratory | Further assesses performance, runs factory production control, keeps the technical documentation |
| 4 | None | Assesses performance, determines the product type and category, runs factory production control, keeps the technical documentation |
The table follows Annex IX of the Regulation. The Commission calls system 3+ new and says system 3 now requires the notified body to confirm the product type in addition to testing (European Commission, CE marking and DoPC).
Notified bodies and technical assessment bodies designated under the old Regulation count as designated under the new one, and each is assessed anew in its periodic re-assessment cycle and by at the latest (Art. 95(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 2Click opens the article on EUR-Lex.). A notified body may recognise another notified body’s assessment of the same operator on three conditions (Art. 62(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 62, paragraph 1Click opens the article on EUR-Lex.). No official source consulted for this page gives a price or a time for a notified body.
Selling online: what the new Regulation adds for marketplaces, shops and distance sales
Today, what the law adds for an online offer comes from Regulation (EU) 2019/1020Regulation (EU) 2019/1020, Market Surveillance RegulationThe whole regulationClick opens the law on the EU Publications Office.. An offer aimed at EU end users counts as made available on the EU market, and a product under the old Regulation needs an operator established in the EU (Art. 6Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 6Click opens the article on EUR-Lex., Art. 4(1)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 1Click opens the article on EUR-Lex., Art. 4(5)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 5Click opens the article on EUR-Lex.). The old Regulation itself has no article on online sales.
The new Regulation adds a set of rules for operators. They apply to a product family, or a category within it, after its switch (Art. 95(9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex.). The marketplace duties and the rule on intermediaries are set out under “What the law leaves open”, because the text does not say whether they wait for the switch.
- What the listing shows. Where required, the offer must show clearly and visibly the CE marking, the details that follow it, the label of Art. 22(9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 22, paragraph 9Click opens the article on EUR-Lex. and the data carrier of the digital product passport (Art. 29(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 29, paragraph 2Click opens the article on EUR-Lex.). A manufacturer, importer or distributor must display the information the Regulation requires to customers before they are bound by a sales contract, distance selling included. The manufacturer must also show a label “Only for professional use” there. A product without that label is deemed also meant for consumers (Art. 22(5)Regulation (EU) 2024/3110, Construction Products RegulationArticle 22, paragraph 5Click opens the article on EUR-Lex., Art. 24(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 24, paragraph 3Click opens the article on EUR-Lex., Art. 25(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 25, paragraph 3Click opens the article on EUR-Lex.).
- What the manufacturer gives you. Once a passport exists for the product, the manufacturer must give an online seller a digital copy of the data carrier and the product identifier, free of charge and within five working days of the request, so that customers who cannot see the product can reach the information (Art. 77(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 77, paragraph 3Click opens the article on EUR-Lex.).
The Commission’s summary of the same rules is on its page for economic operators.
A manufacturer outside the EU needs an EU operator today, and an authorised representative after the switch
Today, Regulation (EU) 2019/1020Regulation (EU) 2019/1020, Market Surveillance RegulationThe whole regulationClick opens the law on the EU Publications Office. lists Regulation (EU) No 305/2011Regulation (EU) No 305/2011, Construction Products Regulation (the 2011 Regulation)The whole regulationClick opens the law on the EU Publications Office. among the laws for which a product “may be placed on the market only if there is an economic operator established in the Union” who holds the declaration of performance and the technical documentation and answers the authorities (Art. 4(1)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 1Click opens the article on EUR-Lex., Art. 4(3)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 3Click opens the article on EUR-Lex., Art. 4(5)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 5Click opens the article on EUR-Lex.). The operator’s name and contact details go on the product, its packaging, the parcel or a document with it (Art. 4(4)Regulation (EU) 2019/1020, Market Surveillance RegulationArticle 4, paragraph 4Click opens the article on EUR-Lex.). A reference to the old Regulation reads as a reference to the new one (Art. 94Regulation (EU) 2024/3110, Construction Products RegulationArticle 94Click opens the article on EUR-Lex.).
After the switch the new Regulation adds its own rule: a manufacturer not established in the EU must appoint a single authorised representative by written mandate (Art. 23(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 23, paragraph 1Click opens the article on EUR-Lex.). Drawing up the technical documentation cannot be part of that mandate. The mandate must let the representative at least keep the declaration and documentation for the authorities, hand them the information they ask for, end the contract if the manufacturer breaks the rules and tell the authorities of a risk, and cooperate on corrective action (Art. 23(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 23, paragraph 2Click opens the article on EUR-Lex.). The Commission says the duty includes manufacturers in the EEA, Switzerland and Turkey (European Commission, economic operators).
An importer or distributor that sells under its own name or trademark, changes the product, gives it a use other than the manufacturer assessed, claims characteristics the manufacturer did not declare, or chooses to take the role is treated as the manufacturer (Art. 26(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 26, paragraph 1Click opens the article on EUR-Lex.). Adding translations, and repackaging that does not touch the product’s condition or the required information, do not make you the manufacturer (Art. 26(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 26, paragraph 3Click opens the article on EUR-Lex.). Who may be the EU operator, and the difference between a representative and a responsible person, is in EU responsible person and authorised representative vs responsible person.
Great Britain and Northern Ireland have their own construction products rules
The UK government’s guidance, updated on 21 May 2025, says the CE marking remains available for construction products placed on the Great Britain market, and the UKCA marking can be used too. To affix the UK marking a business must follow the Construction Products Regulation 2011 as retained in UK law and use a UK approved body. Products with CE marking can continue to be supplied to Great Britain without reassessment if EU requirements are met, and to affix a CE marking any third-party assessment must come from an EU recognised notified body (UK government, Great Britain). That guidance describes the 2011 Regulation and does not mention Regulation (EU) 2024/3110Regulation (EU) 2024/3110, Construction Products RegulationThe whole regulationClick opens the law on the EU Publications Office..
Northern Ireland follows the EU rules. Products must meet EU harmonised European standards and carry the CE marking, or the CE marking and the UK(NI) indication. A product with the UKCA marking alone is not accepted there. A distributor that first makes a product available in Northern Ireland from outside the EEA and Northern Ireland is an importer, and an authorised representative must be established in Northern Ireland or the EEA (UK government, Northern Ireland).
If you sell without the declaration or the marking, the authorities can have the product withdrawn
Under the new Regulation, where a market surveillance authority finds that a product covered by a harmonised technical specification, or its manufacturer, does not comply, it requires the operator to take corrective action, to withdraw the product or to recall it within a reasonable period. If the operator does not, the authority makes sure the product is withdrawn or recalled, or that making it available is prohibited or restricted. The operator must extend the corrective action to every unit it supplied across the EU (Art. 65(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 65, paragraph 1Click opens the article on EUR-Lex., Art. 65(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 65, paragraph 3Click opens the article on EUR-Lex., Art. 65(4)Regulation (EU) 2024/3110, Construction Products RegulationArticle 65, paragraph 4Click opens the article on EUR-Lex.). A product for which a declaration is required, and none exists, may not be made available on the market (Art. 13(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 13, paragraph 2Click opens the article on EUR-Lex.). Each EU country sets the penalties, which must be effective, proportionate and dissuasive. Its duty to lay down the rules applies from , and it notifies them to the Commission by (Art. 92Regulation (EU) 2024/3110, Construction Products RegulationArticle 92Click opens the article on EUR-Lex., Art. 96Regulation (EU) 2024/3110, Construction Products RegulationArticle 96Click opens the article on EUR-Lex.). The old articles on market surveillance and on formal non-compliance were repealed on 8 January 2026 (Art. 94Regulation (EU) 2024/3110, Construction Products RegulationArticle 94Click opens the article on EUR-Lex.).
What you can skip
What the law leaves open
- Which family or category switches when. No date is set for any family. The implementing act for each fixes it, and the Commission’s plan is a plan (Art. 95(9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex.; working plan).
- Whether the marketplace duties wait for the switch. Article 95(9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex. defers “the requirements and obligations of economic operators set out in Chapters I, II and III” for a product family or category until one year after its implementing act. Two readings fit the text. On the first, Article 28Regulation (EU) 2024/3110, Construction Products RegulationArticle 28Click opens the article on EUR-Lex. (online marketplaces) and Article 29(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 29, paragraph 3Click opens the article on EUR-Lex. (intermediaries) wait with the rest: Article 28(4)Regulation (EU) 2024/3110, Construction Products RegulationArticle 28, paragraph 4Click opens the article on EUR-Lex. extends the marketplace article to manufacturers, importers and distributors that sell online without a marketplace, and those are economic operators. On the second, they apply from : an online marketplace is not among the operators Article 3, point (9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 3Click opens the article on EUR-Lex., names, and Article 28(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 28, paragraph 2Click opens the article on EUR-Lex. is a duty of each EU country to give its market surveillance authorities the power to order an online marketplace to remove an offer, “in respect of all products covered by this Regulation”. No official guidance consulted settles it; the Commission’s page lists the duties without a date (Art. 95(9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 9Click opens the article on EUR-Lex., Art. 3, point (9)Regulation (EU) 2024/3110, Construction Products RegulationArticle 3Click opens the article on EUR-Lex., Art. 28Regulation (EU) 2024/3110, Construction Products RegulationArticle 28Click opens the article on EUR-Lex., Art. 29(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 29, paragraph 3Click opens the article on EUR-Lex., Art. 96Regulation (EU) 2024/3110, Construction Products RegulationArticle 96Click opens the article on EUR-Lex.; European Commission, economic operators). The duties are these. A marketplace designs its online interface so that operators can show what Art. 29(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 29, paragraph 2Click opens the article on EUR-Lex. asks, sets up a single contact point for the authorities, answers notices about accidents and incidents, cooperates with market surveillance, tells the authorities of action taken on non-compliant products and exchanges information on content removed at their request (Art. 28(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 28, paragraph 1Click opens the article on EUR-Lex.). An EU country’s authority can order it to remove an offer for a non-compliant product, disable access to it or show a warning (Art. 28(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 28, paragraph 2Click opens the article on EUR-Lex., Art. 28(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 28, paragraph 3Click opens the article on EUR-Lex.). A person that provides an intermediary service for placing products on the market fulfils the listing duties of Art. 29(2)Regulation (EU) 2024/3110, Construction Products RegulationArticle 29, paragraph 2Click opens the article on EUR-Lex. for the services it provides (Art. 29(3)Regulation (EU) 2024/3110, Construction Products RegulationArticle 29, paragraph 3Click opens the article on EUR-Lex.). The test for an offer aimed at EU customers is in Art. 29(1)Regulation (EU) 2024/3110, Construction Products RegulationArticle 29, paragraph 1Click opens the article on EUR-Lex.: the operator directs its activities to an EU country by any means, and, among other signs, uses the currency of an EU country, uses an internet domain registered in one or an EU domain, or dispatches to an EU country. It is not aimed at the EU if the operator explicitly and effectively excludes the EU market.
- Dates on the Commission’s pages. They differ from the Regulation’s text in three places. The overview page says the old Regulation is repealed “in 2039”, where the text reads 8 January 2040, and the new one is in full application “since 7 January 2026”, where the text reads 8 January 2026 (European Commission, CPR overview; Art. 94Regulation (EU) 2024/3110, Construction Products RegulationArticle 94Click opens the article on EUR-Lex., Art. 96Regulation (EU) 2024/3110, Construction Products RegulationArticle 96Click opens the article on EUR-Lex.). The voluntary CE marking page says old assessment documents work until 2030 and their assessments until 2035, where the text reads and, for placing on the market, after (European Commission, voluntary CE marking; Art. 95(4)Regulation (EU) 2024/3110, Construction Products RegulationArticle 95, paragraph 4Click opens the article on EUR-Lex.). This page follows the text.

The Commission says no delegated act on spare parts has been adopted so far.
